What matters is that in a civil case personal liability has been established which opens the possibility for criminal prosecution

Your logic seems to be that every action a governor takes WHEN USING LAW ENFORCEMENT AGENCIES cannot be attributed to personal capacity
For example there is state police and the Governor uses them to declare independence and wage war against Nigeria e.g in the case of Biafra
