ILLEGAL.

A landlord has no legal right to seize or withhold your personal belongings — even if you're owing rent. That's called self-help, and it's against the law in Nigeria.

What should a landlord do instead?

👉 Issue proper quit notice
👉 File a case in court
👉 Let the judge decide the next step

If your landlord locks you out or seizes your things:

📞 You can report to the police
🧾 Sue for trespass or unlawful interference
⚖️ Claim compensation

It is completely illegal. Sue him for detinue in court. The laid legal procedure is to issue you 7 days if your rent has expired or appropriate length of notice (eg 6 or 3 months depending on the type of rent). Thereafter, you will be taken to the rent tribunal for ejection (known as possession in law) and any outstanding rent you may be owing. After this, your property may be seized to defray your debt.

To build house for rent in Nigeria doesn’t look like a wise decision anymore.
After spending millions to build the house, you will still be pursuing tenants to pay up after the first payment. Some tenants will even misuse the house that you will need renovating at a very heavy cost

It is illegal for any landlord or landlady to seize tenant's property without court order from a court of competent jurisdiction. Doing so will amount to resorting to self help which is on its own against the law of the federal republic of Nigeria.

It is legal to confiscate the tenant's property via court order to offset outstanding payments for rent. However the tenant has no right to do that independently.

This kind of posts always comes up when I have accomodations issue grin Our landlord died recently and we're told to leave the house because they want to prepare for the burial. Tomorrow is supposed to be the deadline. They told me in the middle of May.

It's legal for the land to confiscate the tenant's property to offset outstanding rent arrears but it must be done via an appropriate court order

The statement that people always says that if you owe your landlord rent for a certain months and he take you to court and according to the court judgment you are free to stay in the property for 6months without paying a kobo pending on the time you get another accommodation it true?.

I was telling my colleagues today that it's not possible to spend another 6months for free when you are still owing highest they can give is 3months and you will pay

Counsel, I disagree somehow in view of the provisions of the law on bonafide claim of right.


On the face of it, it might be harmless to consider you correct, on face value.

However the position might not hold complete water especially if the bad record of the tenant (flight risk) is considered.

One might say that the excuse of bonafide claim of right is restricted to criminal law, but it's left for both parties to argue their case and the court decides.

Thanks for the insight though.

If you simply collect money and allow the tenant to move in. ..anything can happen . If you're really doing business ...then you make out a lease with all the rules and stipulations .... no animals ... no guests for more than three days without permission...no parties ... no smoking... Apartment inspection last Friday of each month ... etc. When the tenant violated then you can always pull the lease and show him what he agreed to before renting.

Yes nah imagine owing a house and your tenant refuses paying you for years to make it worst is when u are a retiree with little pension to sustain the family. Tenant is now owing u 2years unpaid rent my brother u ll forget court ruling

One thing I always consider is that.This landlord didn't build this house with free raw stones and sand.Its an investment and he has recoup his Investments.

When I have income, I first keep the percentage of monthly savings for rent safe.That money is fixed but no matter how my girl friend shake bumbum I no dey give Shishi.

Most times we all should be considerate.
