"Lagos Court Dismisses Bombshell Defilement Case Against RCCG Pastor – Here's Why"

In a development that has triggered mixed reactions, the Lagos Sexual Offences and Domestic Violence Court has discharged Pastor Emmanuel Orekoya of the Redeemed Christian Church of God (RCCG), who was accused of defiling his 17-year-old daughter. Eyes Of Lagos reports,

Justice Abiola Soladoye struck out the case on grounds of “want of diligent prosecution”, citing that the Lagos State Government failed to produce a single witness throughout the trial, despite 10 adjournments.

Judge’s Verdict: A Waste of Time

“This case is struck out for want of diligent prosecution,” — Justice Abiola Soladoye

The judge emphasized that since Orekoya’s arraignment on February 26, 2024, no witnesses had appeared in court to testify against him.

“It is right that justice delayed is justice denied. The prosecution is at liberty to re-arrest the defendant and bring him to justice whenever they have assembled their witnesses,” she added.

Serious Allegations, No Trial

Orekoya was charged with two counts of defilement and sexual assault by penetration, allegedly committed in 2017 at Jacob Adeleye Street, Odo-Eran, Itire, Surulere, Lagos. The state had accused him of inserting his penis into his daughter’s mouth, a grave charge under Sections 137 and 162 of the Lagos Criminal Law (2015).

The pastor pleaded not guilty, but with no witnesses stepping forward, the court had no option but to dismiss the case.

What Happens Next?

While the case is now closed, the court granted the state the liberty to re-arrest and prosecute Orekoya if and when they are ready with evidence and witnesses.

The idea of arresting before working up a case as done by Nigerian security agencies is appalling.

You have limited evidence, limited or no witnesses, but you hastily arrest and publish the case with pictures of the possibly innocent person.

Even though the case has been struck out now, this man's name is now forever attached to this defilement case....what if he's innocent? Who will go about deleting all the embarrassing details online? How will this affect his life moving forward?

Nigerian security agencies must learn to do their due diligence before going public. I'm particularly targeting the EFCC and the NPF on this post.

Their lazy approach of arresting anyone and muscling out statements from them should stop. They should do better.

Who reported the case? Where's the girl's mother...her siblings? Witness doesn't necessarily mean that one saw the act as it happened. Where's the victim too? All these testimonies should be enough to execute the case.

Another angle to look t it. Possible. Maybe they want out-of-court settlement.

If this is the case, then it's shameful. If the man did it, for the sake of the girl and for possible future victims, those with relevant info should approach the court and testify. He should go to jail and be off civilization for as long as necessary.

Imagine him going back home...how will the young girl feel?

As a practicing lawyer, I can assure you that you are very wrong...underage persons can give evidence in court as long as the court is convinced he or she understands the questions put to him or her...

And minors can also be tried for criminal offences..

So many cases of sexual assault never even make it to the court because victims and / or their relatives are not willing to pursue the case. In some instances, the accused might even be asked to "settle" the victim.

If it were in a foreign country. Despite been innocent his name would be tarnished for life because it's already in his record except he has a high connection in the white house which would help in expunging the case file even with some companies or workplace wouldn't employ him. Those people are more profiling compared to us when it comes to sexual assault or rape and would support the opposite gender mostly without even giving it an iota of thought if the man is innocent but here they go ask the lady or woman say wetin you go find there. Double standards allover the 🌎
