Certified True Copy of the judgment of the Federal High Court, Abuja, presided over by Hon. Justice B.F.M. Nyako in the suit filed by Senator Natasha Akpoti-Uduaghan against the Clerk of the National Assembly, the President of the Senate, Senator Godswill Akpabio, and the Chairman of the Senate Committee on Ethics, Privileges and Public Petitions, is out. Quoting the court verbatim. IT IS HEREBY ORDERED AS FOLLOWS; 1. That all previous Orders and all pending applications before this Court became seized the matter are hereby set aside except the Originating Summons, preliminary objections and motion for interlocutory injunction which will be taken together. 2 That having found that the Plaintiff acted in breach of this court’s subsisting order, the Plaintiff must take responsibility for her action and remedy same. Thus, an order is hereby made for the Plaintiff to pay a fine in the sum of N5 Million to the Federal Government Treasury and to publish a public apology to the court in two (2) National Dailies and on her Facebook page within 7 days of today to purge herself of the contempt. 3. That the preliminary objection succeeds in part in that some aspects of the cause of actions may be inchoate but in enforcement of fundamental rights an act can lie where the mnfringement is in anticipation – is being, has been or is likely to be breached. 4. That the application for interlocutory injunction filed, which reliefs are similar to those in the Originating Summon are hereby subsumed into the Originating Summons and shall be determined together. 5. That reliefs 1, 2, and 3 calls for the interpretations of Order 9, 10 and 11 of the Senate Rules that touches on the privileges inuring to a Senator. 6. That a Senator can only raise issues of privilege upon complying with the provision of Chapter 3 Order 6 of the Senate Rules. 7. That I also find that the Senate Rules is superior to the Legislative House (Powers & Privileges) Act by virtue of Section 20 thereof. 8. That Order 6 of the Senate Rules gives the power to allocate and re-allocate seats to Senators to the Senate President without conditions. 9. That reliefs 4 and 5 bordering on the actions or non-actions of the 2nd and 3rd Respondents, I find that for as long as the Senator (Plaintiff) is not speaking from the seat allocated to her, the 2nd and 3rd Respondents cannot and should not take any steps in the Plaintiff’s matter as the Plaintiff has not complied with the Senate Rules which govern her as well. 10. That to suspend a member for a period of 6 months equals to a suspension for 180 days and this is the same number of days a member is expected to sit in the House, representing his people. That I find this excessive and over reaching noting that it will prevent a member from complying with Section 63 of the 1999 Constitution. 11. That I am of the opinion that the senate has the power to review the provisions of the Senate Rules and can even amend Section 14(2) of the Legislative Houses (Powers & Privileges) Act both for being excessive and over reaching. 12. That the Senate has the power to and I believe should recall the Plaintiff and allow her to resume representing the people who sent her there to represent them.

But de case of Natasha is dat of de saying 'that de dog dat will lost will not hear d whistle of the hunter'. Whenever she's done with all her court circus she will still come back 2 apologize B4 she's reinstated. Wat is wrong in apologizing wen we're wrong? In a nutshell, Senator Natasha did not secure any court victory as some people wanted us to believe. She was rather found guilty of contempt. The court asked her to publish a public apology and pay a fine of 5 million naira within 7 days. |

The court played it safe. If the constitution stipulates that a lawmaker must sit for a minimum of 180 days, it then implies that the National Assembly does not have the power to suspend a lawmaker in excess of those days because it would then be compromising the lawmaker's ability to comply with the provisions of the Constitution. In essence, the suspension of Senator Natasha in excess of 180 days is unconstitutional, and therefore ultra vires on the part of the Senate. |

Paragraphs 11 of the Judgment even makes it clear that that " in Justice Nyako's opinion" the Senate can review it's "laws on suspension" ,... Where is the Order here? Justice in Nigeria is fully for the highest bidders. If Justice can be out of reach for somebody like Sen Natasha, a high class citizen with her kind of connections, then I fear for you and me (the commoners) that have aligned ourselves with the contending parties based on our party affiliations. I cry for what awaits the vast majority of Nigerian populace that cannot afford seeking justice from Nigeria judiciary. |

Some of us don't understand the law . Any law that runs contrary to our constitution is considered null.and void . Recall the judge was able to state clearly that 6months suspension runs contrary to not only the Senate rules but also against out constitution..To that extent compliance might not be achievable ...You cannot give what you don't have. The Senate has made a mistake in suspending her for 6months ...They shoukd swallow there ego and do the right thing by allowing her do her duties . Already she has been fined for speaking about the matter on her Facebook...which court called contempt... The danger in not calling her back means anybody can now use an arm of government to punish those he or she doesn't agree with . This is new to out constitution....They were sent there to make laws that impact meaningfully to our country ...not to use the instrument of power as political tool to intimidate others |

She was out of order by refusing to change her seat..that’s where the senate president has powers over her!!!..she could have obeyed and later sue the senate president for sexual harassment not using the latter as an excuse to disobey the senate president on the floor!! |

Justice Nyako's Upheld the Powers (already secured) of the Senate to decipline it's members according to Senate rules..( par 12 of the Judgment) ...... Opinion is personal and just an advise to the Senate to in the future try to sit (1st) and (2nd) try to reconsider amending the law which is effective on principles but seems excess in Justice Nyako's opinion....she was pleading to the Senate.....but Boom.,..
