Difference Between Marriage License And Marriage Certificate by EmebonMM(op): 9:23am On Aug 02, 2025
If you're planning to get married, it's important to understand the difference between a marriage license and a marriage certificate. While both documents are essential in the marriage process, they serve very different purposes and appear at different stages of your legal union.

What is a Marriage License?

A marriage license is an official document issued before a wedding takes place. It serves as legal permission granted by the government (usually through a local marriage registry or court) for a couple to go ahead with their wedding ceremony.

Before issuing the license, the government may require proof that both parties are legally eligible to marry. This often includes:

• Birth certificates
• Valid national identification
• Passport photographs
• Affidavit of single status or proof of divorce (if applicable)
• Parental consent (in the case of underage applicants)

Once approved, the license typically has a validity period—often within 21 days in Nigeria—during which the marriage must be conducted. If the couple fails to marry within that timeframe, they may need to reapply for a new license.

In essence, without a marriage license, the law does not recognize your permission to marry. It’s the green light that authorizes the union to take place legally.
What is a Marriage Certificate?

On the other hand, a marriage certificate is the official document issued after the wedding ceremony has been successfully completed and properly registered. It acts as legal proof that a marriage has occurred and has been officially recognized by law.

This certificate is vital for many post-marriage activities, including:

• Applying for a change of name
• Opening a joint bank account
• Applying for spousal visas and immigration benefits
• Making medical or legal decisions on behalf of your spouse
• Proving marital status in court or for inheritance purposes

The marriage certificate contains key information such as the full names of both parties, the date and place of the wedding, and the type of marriage conducted (customary, statutory, or Islamic).

When Do You Need Each Document?

The marriage license is needed before the marriage. Without it, you are not legally permitted to marry under statutory laws in Nigeria.

The marriage certificate is obtained after the marriage has been conducted and registered. Without this, you may have no legal documentation to prove your marital status—even if the wedding ceremony took place.

So, the license gets you through the door of marriage, while the certificate proves you walked through it.
Why This Difference Matters

Many couples confuse these two documents or assume they are the same. However, treating them interchangeably can lead to serious problems such as:

• Wedding delays due to missing legal authorization
• Inability to register the marriage, resulting in no certificate
• Legal challenges with embassies, immigration services, or financial institutions
• Difficulties in claiming spousal rights or benefits

For example, a couple may have a traditional wedding ceremony and think they are legally married. But unless they also obtained a marriage license beforehand and registered the union afterward, they may not be recognized as legally married under Nigerian law—especially for international or official purposes.

Types of Marriages and Legal Documentation in Nigeria - In Nigeria, marriages may be classified as:

• Customary Marriage – conducted under native customs
• Islamic Marriage – based on Islamic principles
• Statutory (Civil) Marriage – governed by the Marriage Act

Of the three, statutory marriage is the most widely accepted both within and outside Nigeria. It requires both a marriage license before the ceremony and a certificate afterward. This type of marriage is often required for applications involving foreign embassies, visas, insurance claims, and other legal matters.
The Bottom Line - To summarize in plain terms:

• The marriage license is like getting approval to marry. It comes before the wedding and gives you the legal go-ahead to proceed.

• The marriage certificate is your proof that the marriage actually happened. It comes after the ceremony and registration process.

You need both documents to ensure your union is legal, recognized, and protected under the law. Neglecting either can put your marriage—and your rights as a spouse—at risk.
Final Advice

If you’re planning a wedding in Nigeria, be sure to:

• Apply for your marriage license well in advance.

• Have your wedding conducted under the proper legal framework (especially if you want it recognized internationally).

• Ensure your marriage is registered at a recognized registry so you can obtain your official certificate.

Don’t skip steps. Both documents play important roles in protecting your rights and securing your future as a legally married couple......Continue Reading

Thanks for the information. I know friend who obtained the license and later did to church wedding with church certificate not court certificate. Can he use both the license and the church certificate for travelling and for other activities?
Re: Difference Between Marriage License And Marriage Certificate by EmebonMM(op): 9:39am On Aug 02, 2025
Hi Obiedun,

Happy New Month.

No, your friend cannot rely solely on a marriage license and a church certificate (issued by the church) for official purposes like international travel, visa applications, immigration processing, or legal documentation. A government-issued marriage certificate is the only officially recognized proof of marriage in Nigeria and abroad.

What Should Your Friend Do?

If he did not obtain a court-registered marriage certificate, he should:

Confirm whether the church is authorized by the Ministry of Interior to conduct legal marriages.

If not, he should:

Visit a marriage registry (either local government or federal)

Register the marriage officially (even if the ceremony has already taken place)

Obtain a valid marriage certificate

Most likely, the church is authorised to conduct a marriage ceremony by the government and would have given them the same document they would have likewise received from a marriage registry. Else, they would not have required or requested for a marriage license.

He just went to the local government registry to collect the license. The church did not even take the licence. They just went ahead to do the wedding. The church is a local church in the village. The pastor didn't want to hear about government approval.

Ha! That's serious o. He should go back and do the wedding proper. Go to the registry, ask for the necessary requirements and just go through with it.

Can they backdate the wedding date to meet up with the exact date of the wedding?

No, they can't.

Happened to someone I know. It's not really a big deal. The legal wedding document is just for official matters like opening joint accounts, travelling abroad as a couple etc.
Their wedding anniversary date still remains the same date they got married before God and people.

Alright then. That means if he want to travel out with their children born about six years ago and the marriage certificate shows they got married last month there is no problem

I really don't think there is a problem, sincerely. In as much as they are the parents of these kids. The problems can arise if one of them is either not the biological father or mother of the kids and the biological father/mother objects to their travelling, refusing to sign the consent form enabling them to leave the country.

The children are their biological children. But he was thinking there may be questions if the children are older than the date the parents get married. The family is planning to travel abroad with the children.

It's no issue at all. If that were to be the case, then that means those who gave birth out of wedlock are going to have issues, which is definitely not true.

I get what you are saying but what I was trying to bring out is that will they not think those children are not his since the children are older than the marriage? Won't they think he just wants to just travel with those children? But since you said there won't be problem, I will let him know.

Like I said before, people give birth out of wedlock and it has never been an issue. All they need is that he is the father stated on the birth certificates and their mother's name is clearly stated too.
