Now, in understanding, interpreting a legislation, the reader, interpreter must first seek to understand the intention of drafters of such framework. Knowing the spirit behind it better helps against misconstruing provisions. Yet again, a document or legislative framework is read in a whole. You do not isolate a provision, read it and think you can interprete the whole. You called in aid Section 26 of the National Data Protection Act, 2023 which speaks to consent of a subject with relation to his data but failed to cognizance of limitations to the Act itself provided for in Section 3 of the Act, and for this case particular emphasis is at Section 3(2)(d) of the Act, since it touches on journalism. For proper context, Sec 3(2)(d) of the Act is here under reproduced; 3(2) “Subject to the rights and freedoms under the Constitution and the limitations, the obligations under part V, other than sections 24, 25, 32 and 40 of this Act, shall NOT apply to a data controller or data processor if the processing of the personal data is- (d) in respect of publication in the PUBLIC INTEREST, FOR JOURNALISM, educational and literary purposes…” Please do not just go check privacy laws on AI and start arguing. Get your facts right. If we go by your analogy, that means every body that walks past while a reporter is in a location reporting, will have a case against such station especially in market places where reporters walk into, capture reports and faces of people without their knowledge or consent. |

The Governor of Kebbi State has suspended his health commissioner for negligence of his duty, a further reaction by his administration to the viral video by the arrested Journalist. The very premise of my opinions is that the same message can still be passed in a more professional way as a journalist that won't warrant being arrested for doing ones job as journalist. Once again thank you for your enlightenment. |
