If you read the letter , technically they were not sacked for joining Union but let go due to reorganization grin. Their benefits accrued them due to this downsizing will be due them, it's dicey situation for them.

90% of staff? Dangote overdo this one, the extent laws are there to guide us, workers can join unions.

What do you mean by full monopoly? Has Dangote stopped anybody from building a refinery? Go build your refinery and employee union members.
Unionism is not a bad thing, it can be very helpful to employees. But it was very stupid of NUPENG and PENGASSAN to try to hijack Dangote's business and impose their rules on him, less than 1 year after he started operating his refinery. Where were they when he risked his resources, borrowing $20b and struggling to build the refinery? Did they form union to assist him in anyway? Nonsense!

This is very interesting. Unionism either die a natural death or continue to exist as a means to siphon resources from the people.
There are many things that will be tested as Nigeria 🇳🇬 gradually head to a possible better future.
This your response deserve an accolade..

This dangote refinery that probably pays workers < $400 a month might just be looking for a way to pay even lower salaries to new recruits

There is nothing wrong joining unions, that you have been in the job market for 5 years doesn't mean what is wrong is now right, don't use your personal experience to determine what is right or wrong the laws of the land has stipulates the right and wrong situations on paper.

Union in a private organization?

I doubt if it works. What does the PIA say about unionism?
There are Unions in all big oil firms you can think of, they are all privately run.

Isn't it possible to get an internal union?
Like a private union amongst it's members only that fights for their collective interest?
That should be accepted by Dangote Refinery.

Nigeria guys are chronically wicked if in top positions. If you know what Olam is facing now. If you know how many Billions of Naira missing btw 2020- 2025, see, you never want to hire any Nigeria into your company. Many are thief. So don't blame dangote o. And if u think it's easy. Go and build your own refinery and pack your village and town people there. Come back and share your experiences.

shoodboi2:
Person pack indians full for im company, you think say na play? That Dangote man is very cunning. He knows how to run the perfect monopoly. He only puts indians in top positions so he can easily dismiss them without drama when they fall out of line.

Nigerians are always at lower positions where they are weaker and at his mercy. Meanwhile, the government, regulators, and judges who are supposed to ensure he follows rules and processes look the other way.

Meanwhile, Dangote's Nairaland media crew will soon overtake the thread.

Personally, I don't like unions.
They do nothing for the masses but only protect the interests of their few members.
An example is that they are the ones that forced Yar'adua to reverse the sale of the local refineries so that their members continue receiving free salaries without work. If not for them, we'd have working refineries since 2008.

Anyways, they will test this in court. It is good for our legal system. Workers have a right to join unions, but employers also have a right to determine who to hire or not.
They used to . I believe unionisms flourish and are effective under military rules . They become problematic in democracies. In fact Unionism has died in Nigeria . They just form activity , shout on TV , beat their own members for going to work , collect money from the government and their member , call off the strikes but workers are worse off .
Labour laws already protect workers in private and public sectors . If you are not fine with your employer take them to industrial court .

The union exists to protect workers from management excesses and to ensure workers have a fair wage and to prevent victimisation

I will give a very simple example.

I worked in a Nigerian run oil company

They were able to cancel union in some parts of the company

One year management made a bad financial decision

The group ceo met with us and promised no one would be sacked

The next thing the non unionised guys were laid off with one month severance pay

I was exited four years later. I was paid severance pay equivalent to my years of service

An even funnier story is that the ceo of my unit who had always bragged about how he had always been a contract staff and had done so well without a union was exited with a miniuscle exit package of 10m. The person after him the coo who had been a full staff and had been in union before took an exit package of over 80m.

That is just one aspect. When you are unionised you can only be immediately sacked if you are in gross misconduct or theft.

Don't let any of these paid shills or naive children deceive you

There is strength in numbers

You can break a single stick but it is much harder to break a bundle of sticks
Your instance is within the ideal hemisphere, all private

You see the moment it involves, FG, labour and outsides forces Forget it ... dem go carry una cash out

Asides FG i dont think there is any private employer in Nig. that employ more than Dangote, you want to tell us to be weary of a Dangote that has being in existence for over 20yrs citing " imaginations"

In the last 20yrs how many scandal does dangote have dealing with his workers, dangote cement factory is not under union ... my lil bro worked there what did he miss, please let's stop over glamorizing this corrupt union

If the Lagos state government makes sure they all pay PAYE and all have pension accounts and etc there will be little need for a union. However there is no big deal in workers paying union levies. It makes the union to have a voice. Money makes you have a voice

But they are supposed to belong to a labour union, by labour laws. PENGASSAN is seeming to stress out Dangote refinery with their endless greed. If the company say NO to the members belonging to the union, the staff must follow the company.
The workers have the right to belong to a union but it is no compulsory that the union should be NUPENG OR PENGASSAN.

No company rules violate your Fundamental right in real sense ... You have exclusive right to resign or dont apply there

if i say all my workers must wear hijab,.... your main fundamental right is " choice" either work with me or say No and exit ... no be everything be fight

In this case court cant do much , because the affected employees are not existing Nupeng members, these are freshers even Nupeng cant protect them

where court have power to decide is, If Dangote employees were already registered to Nupeng and dangote acts against them cos of unionism action
Well they are also labor laws...

And these workers also have an employment contract.

It's not simple a matter of "exiting" if not satisfied. It's a matter of legal rights.

The worker has certain rights due him just as the employer has rights.

That's why they is the judiciary to settle such issues.

To me personally, workers joining a legal association that isn't proscribed by law is their legal rights and as long as the association isn't a threat to company's business they have a right to belong.

I think it's oppressive and discrimination if dangote lays them off for wanting to exercise their rights.

Anyway that's why we have courts to interpret and give judgment in cases of dispute like this!

How low our unions have fallen, they have become thugs and lackeys for kleptocrats, they no longer fight for the interests of workers but for government and big business.

They have lost credibility, see ASUU for example a colossal failure, for over 20 years.

When the leaders of labour unions sellout for selfish interests this is the cause.

Greedy billionaires will take advantage to reduce workers to slaves so they can earn billions and people praise them for being savvy, when in actual fact they re just stealing destinies of others.

It's up to the customers to return the favor by boycotting their goods, time to make a statement.

BOYCOTT!! angry

However unions should only be restricted to levies from workers. They should not be allowed to charge things that are like income tax. Oil unions want to be charging when tankers load

His company does not exists in space. He has no right to stop workers from joining the Union according to the Law.

That is why he has accused them of sabotage which in itself is a mistake and can be challenged in the industrial court.
If you own Dangote Refinery would you be talking like this?
Investing billions of dollars and expecting someone who did not invest anything to dictate to you and hold your business to Ransome.
Importantly did you even understand the effect/implications of they blocking his refinery entrance.

It is very simple, if your employment letter clearly stated that you cannot join any union, please keep to those terms. I believe its a free world and a personal business. you have the right to stay or move and Dangote also have the same right to either keep you or terminate your employment.
