Is it by force to join the association, or have they forgotten the meaning of private
I advise you people should sit down and learn. Is Shell, Chevron, seplat, etc not private. Go to those companies their staffs are happy but it's only Dangote refinery that is suppressing his workers. We know how most staffs are suffering there.
Lastly, there is no country without unions. I just see lots of ignorant post about this whole thing on nairaland.

Please don't even support this pengassan criminals bro this is my industry, this guys are criminals they have caused a lot damage to oil and gas industry in Nigeria. Shell sold all their onshore assets is because of this guys awards all sorts contracts to themselves and cronies declared productive wells non productive turn around sold to their friends. They are evil if dangote want to succeed he must not allow them to occupy strategic positions in his company. NNPC is not working is because of this guys.
Then we should now support Dangote that is doing same evil to Nigeria workers. If you don't have anyone that has worked them find out yourself about Dangote refinery. They under pay their workers. An oil sector is an oil sector. I have been in oil industry and we have had people that have worked with Dangote and every single one of them are never happy.

how does that law make any sense..
do banks have their own union, do private university have unions..

what business does a private venture have with union..
the best is if a company is accused of improper treatment of workers ..they can be taken to court ,..that is the government's job
DatNiggaDaz:
Dangote you are the lawless person here. Obey the laws of the Land as provided by the constitution.

You have now resulted to big möney Media campaign against the rights of workers. Shell, Oando, Cheveron and Private international petroleum enterprise has been obeying the employment laws as regards the rights of workers to be Unionized.

You think you are above the law. You just came recently into the field and behold everyone must bow to you.

You are playing with fire. You must respect the laws of the Union members. You succeded in deceiving most Nigerians during the cement saga and now you are acting the alpha and omega in that sector.

Your intimidations and aim to control and monopolize the oil sector will definitely fail.

You are not made for this smoke with PENGASSAN

It's like you don't read to comprehend! Dangote did not sign any agreement with PENGASSAN! If those agreements are disrupted by PENGASSAN, Dangote can sue those companies for breach of contract. So you can see that Dangote will ask those companies to pay for its lose.

Bro you know absolutely nothing about the oil and gas industry you are so talking about. And the reason for the refineries not working is purely due to the corrupt nature of Nigerians and their government officials, they budget millions monthly for the refinery upkeep and they siphon the money through corruption, and no one asks any questions. Are you aware that even NLNG is a member of the same PENGASSAN, so why has it not gone bankrupt, because there is accountability over there? The company is not run directly by the Nigerian government, even though the NNPC also has the highest ownership of over 50%; the private ownership still has a lot of say there.
I have worked in both the Dangote Refinery and also NLNG, and I can tell you for a fact that Dangote Refinery is never a place for any Nigerian to work ;it is obviously an Indian company wanting to sell refined products to Nigerian final consumers. Those Indians are something else.

It's the Indian part that bothers me the most in the whole story. Are they shareholders in the Company or is Dangote married to an Indian?

1. Shell and other similar companies sold their assets because of the cost of security and community interferences. Pengassan members are not even in management talk less of having the power to award contracts

Second nnpc is working. You are the one who doesn't know that refinery is only a part of nnpc.

Lastly pengassan members are not management in any company. Let that sink in
Now continue dispensing fuel. Awon oil industry worker

If it is voluntary...why does the union want to shove it down the throat of the company..
Their stands IS that all the company's workers must be under union.. and this is for ulterior motives..
You can continue to deceive yourself that it is truly for workers welfare.. cabals who want to bring down the refinery want to use the workers to penetrate into the facility and control..

A clear example has been set.. IOCs who have no business with this are about to go on strike.. the union didn't go on strike when 3bn dollars was spent to rehabilitate dead refineries and none of them work today ..

Even the cement manufacturing division of Dangote group have unions.. it is not like the Dangote hates the initiative..

This case is different

.you think Dangote is a fool to not know what they want to use so called Union to do his refinery?
NNPC tried by trying to starve the refinery from receiving crude. Dangote went ahead to import crude And the fact that his facility sits on a free trade zone gives him the right to do it and most importantly..his facility can crack any crude meaning he doesn't need to stay dependent on Nigerian crude..NNPC failed..

NUPRC tried by calling products from Dangote concentrated with impurities (sulphur) today Nigerians attest to the fact that the product of the refinery are the best for their engines...NUPRC failed..

NUPENG tried by threatening to prevent lifting of products from the refinery..Dangote bought 4000 trucks to do it himself..they failed..

It is PENGASSAN turn..let see how it unfold..

Some how ..all these unions never stood up when the refineries died..when people were stealing crude and subsidy money.. when people imported adulterated products because they are complicit..

You can keep deceiving yourself..

You can wail and lament forever but it will not change the fact that unionism is legal and lawful in the labor within Nigeria and abroad.

No union forces staff of any organization to join them, however the Union will not allow any organization within their space to prevent, expressly oppose or victimize their staff that join unions. The unions will take up the challenge with such organizations.

Is the Union the government or the owner of the refinery that you want them to stand up? The federal government and management of the legacy NNPC refineries ran the refineries aground and killed it. They will only have legitimate issues with government or the acquirers of the legacy refineries if the welfare, benefits, payoff and gratuities of their member staff are not paid.

The unions are not the Nigerian security forces who should ensure crude oil isn't stolen. The unions are not PPPRA or Ministry of finance who should verify and confirm due subsidy payments. The unions are not the standard organizations that verify the quality of petroleum products imported into Nigeria. Take such issues up with the appropriate organizations, not the PENGASSON or NUPENG.

You still have not read about "Force majeure" or you deliberately don't want to see the point.

Any of the parties to any contract can declare "Force majeure" in accordance with the terms and procedures stated in the contract.

"A party to a contract can declare force majeure if an unforeseen, external event makes it impossible for them to perform their contractual obligations, provided the contract's force majeure clause allows for it. The declaration must be done according to the specific terms of the contract, including the event's definition, the notification period, and the required details about the event and mitigation efforts."

In other words, Dangote Refinery or the Contractor Company can declare Force majeure if the contract could not be fulfilled due to labor strike which is a condition beyond either party's control.

You pitched a situation whereby the shutdown by PENGASSON can affect the ability of the companies engaged to supply Dangote Refinery crude oil, you said Dangote Refinery could sue those companies for failure to deliver.

That is the reason I called your attention to "force majeure" clause in every of such contract. This "force majeure" can be triggered by either the company or Dangote Refinery in the event of PENGASSON strike disrupting their ability to deliver on the contract.

PENGASSON gave a short notice. The law doesn't expressly state the length of the notice.

I hope you have been educated.

ASUU is the Trade Union of University Academic Staff in Nigeria, but they don't disturb Covenant University, Baze University, JABU, Crescent University, Babcock and all other private Unis to allow their lecturers join the Union.

NURTW is the Trade Union of Road Transport Workers in Nigeria, but you don't see them go after GOD IS GOOD, GUO, EKESON and the likes, even if they are in the Transportation business, their drivers don't also join any Union.

NUT is the Trade Union of Teachers in Primary and Secondary School, but you don't see them go after Chrisland College, Grange School, Charterhouse Lagos, British International College and tell the teachers to join them.

But you think it is ok for Dangote to build a Refinery solving all our collective petroleum imports problems, and then, allow PENGASSAN to dictate to him and shut down his Refinery whenever they feel like.

I think any Refinery worker that is not happy at Dangote Refinery and needs the Union to help him, should seek employment somewhere else, or take Dangote to court.
