A structure that does not have planning permission by the authority vested with the power to issue planning permits is by definition an illegal structure. The land is owned by the federal government and it was granted to the federal government for a specific purpose. Once state land granted to the federal govt is to be used for a purpose other than the purpose for which it was granted then the permit must come from the state. In any event, the planning permit for all properties in a state MUST come from the state govt.

Federal govt cannot give planning permission/ building permits outside the federal capital territory.

Therefore the planning permit they claim to have which was supposedly issued by the federal govt is null and void.

Many states have properties in Lagos as Lagos state used to be the capital and many had liaison offices or governors lodges. Oyo state for example cannot decide to sell any land or property it owns in Lagos for a different purpose and then issue building permit to the purchasers.

EVEN the federal government itself cannot erect a structure in any state without a building permit issued by that state except that property is for defense purposes.

How does one confiscate a property, that has no building permit?

It must be demolished first, before any question is asked.
