What you are saying is exactly what lawyers study in school for years. They are not expecting any of the witnesses to agree with them, but any answer the witnesses give will help Nnamdi Kanu's case one way or the other.

I don't know of any country with a legal system that exists in a vacuum. At all levels, rightly or wrongly, politics also comes into play.

Read the post again. There are two categories of witnesses. The TY and co are category two witnesses called 'the compellable witnesses'

Brilliant move by MNK. Firstly if the anyone and everyone except for a minor and mentally challenged is a competent and compellable witness under the Evidence Act. So if the court declines to issue the subpoenas for those listed, the court would be seen as biased and denying him fair hearing which is a serious matter in a criminal trial. Secondly if the court grants his application and issues the subpoenas for the compellable witnesses, they will have no choice but to show up which will be hugely embarrassing and inconvenient for those mentioned. So they will likely decline on grounds of health, national duty or unavailability, which MNK will obviously try to use to make for lack of fair hearing as his witnesses refused to show up. Thirdly if in the unlikely event that they show up, the optics of these heavy weights as MNK's witnesses will be something the State will not be comfortable with as it will be in the funny situation of cross-examining its own former or current agents. Meanwhile MNK will come up with tricky questions that will exonerate him to these witnesses This will play to MNK's advantage as it is pitting the State against itself. The government might be forced to issue a Nolle Prosequi in order to seek for a political solution.

Whichever way it cuts, this is a masterstroke from MNK. Let's see how the prosecution neutralises this move by MNK.

He's not forcing them to support him, they are compellable witnesses.

The compellability of a witness refers to the power to force a competent witness to testify even if it's against their will. If the witness is not willing to participate voluntarily they must be "compellable" before a subpoena can be issued

ESN formed by kanu is older Ebube Agu that was formed by the eastern governors , in fact it was the failure of south east governors to create a regional security to tackle the herdsmen killings in the south east that made the people to cry out to nnamdi kanu to do it which he did in December 2020 that was almost a year of the people of south begging the south east governors


Ebube Agu came later in 2021 and instead of going after herdsmen they went after ESN and that was where the problem started

You have no evidence to heap the killings of civilians in SE on ESN

This is a brilliant and uncommon development in legal jurisprudence. I foresee law students studying it for many years in the future.

Malami as a witness will explain why he failed to comply with the Appeal Court’s ruling that discharged Nnamdi Kanu. If he insists he complied, then the DSS Director as a witness will have to present proof of Kanu’s release. If not they both have established that the federal government has a record of not obeying court orders.


Buratai as a witness must account for who ordered the military invasion of Nnamdi Kanu’s residence in Umuahia to kill his father. If he denies ordering that operation, then he's simply telling the court that unidentified armed groups were active in the Southeast and they clearly cannot be linked to IPOB, since it would make no sense for IPOB to attack its own leader and kill his father.

Congratulations to Kanu’s legal team
In real court of justice, Kanu have won this case with this move.

Regarding Nnamdi Kalu's matter, lust for cheap cash from crude oyel in the Niger delta region, that's what is turning some people berserk.

Honestly, the backwardness of una country Nigeria has eaten away common sense and good sense of judgement from some of you, plus tribal hatred and stupidity.

You all were shouting open your defense and stop running away from trial few days ago, now kanu has agreed to open his defense and has listed his witnesses, and you guys started crying. This shows how foolish some of you can be.

Do you know what is terrorism charges, do you know the punishment it carries ?, Something that if kanu fails to defend himself properly, he will be sentenced to death....of course to the joy of you igbo haters.

Or you think kanu will be foolish to open a weak defense in a court that has been mandated to convit him ? , He will defend himself in a strong way that the world will see the truth, and if he is wrongly convicted, the world will know...or you don't know that there are people monitoring this trial all over the world.

Those 23 listed witnesses must appear before the court, especially the compellable ones, wether they like it or not. And to cap it up, they will be subpoenaed, so no room for mago mago ... Everybody will feel the heat. The most beautiful thing about it is that the prosecution has closed his case, so can't do anything about it anymore.

So I did some further digging and found a precedent in the case of Asari Dokubo v Federal Republic of Nigerian (2007) LPELR-958(SC).

Asari called on witnesses who refused to appear, so the trial judge issued summonses. Well, guess what happened? Even with the subsequent bench warrants issued, they maintained an uncooperative stance.

As you probably know, Asari was ultimately convicted despite the violation of his constitutional right to a fair hearing, which is guaranteed by section 36(6)(d) of our 1999 constitution.

By the way, our Supreme Court also ruled at the time that, while a witness can be compelled to give evidence in court, this right is contigent on the witness' availability.
