This for sure is a wise decision. 1. The prosecutor has linked Nnamdi Kanu as a mastermind of the End-Sars protest. While the report of End-Sars protest Judicial Panel of Inquire never linked Nnamdi Kanu to the protest. Sanwo-Olu is listed to come and testify to the End-Sars report, given that the panel was constituted by the Lagos State Ministry of Justice. 2. On the part of Danjuma, Kanu is also accussed of setting up a security formation (ESN) without legal backing. Danjuma was a top security personnel in one of the government security agencies. Due to the persistent kills across Nigeria, he has once asked communities to defend themselves against insecurity. That government alone cannot do all. In his video he didn't mention whether communities need any form of approval from government to have a formation to defend themselves against insecurity. This must have been one of the bases that made Nnamdi Kanu to mobilize community members to form ESN inorder to defend their communities against insecurity. Hence, Danjuma need to appear in court to affirm his directives as evidenced in a video published by known media. 3. Malami's part is very sensitive as it boarders on how Nnamdi Kanu was repatriated from Kenya to Nigeria. Which the process is against the international treaty Nigeria signed. Malami served as the Minister of Justice and Attorney General of the Federation under Buhari. 4. They said he jumped bail, Burutai will explain to the court why he ordered the army to attack him MNK in his house leading to the death of over 25 persons, which lead MNK to flee and run for his life. 5. Wike will explain the obigbo massacre. I think the list is cool to make a good defence. But the question is, are these people willing to present themselves to the court. In Nigerian justice system If someone refuses to appear in court after being subpoenaed, they can face serious consequences, including¹ ² ³: Contempt of Court: The court can hold them in contempt, which may result in fines, imprisonment, or other sanctions. Arrest Warrant: The court can issue a warrant for their arrest to secure their attendance. Prevention from Giving Evidence: They may be prevented from giving evidence in the case. Adverse Findings: The court may make adverse findings against them. The consequences are quite severe, so it's essential to comply with a subpoena or seek legal advice if there are concerns about appearing in court.? |

CHATGPT.COM Based on the available information about **Nnamdi Kanu’s defence strategy**, here’s a structured commentary on both the **litigation strategy** and the **likely reaction of the court**: --- ## ⚖️ LITIGATION STRATEGY: Analysis ### 🔹 1. **Broad, high-profile witness list** Kanu’s decision to list **23 witnesses**, including **top government officials**, **military leaders**, and **state governors**, appears to serve several strategic purposes: #### ✅ a. **Political framing of the trial** By naming figures like **Malami**, **Wike**, **Sanwo-Olu**, **Danjuma**, and **Buratai**, Kanu signals that this case is not just a criminal trial, but one that has **deep political, institutional, and national security implications**. This attempts to shift the narrative from one of individual criminality to a **broader systemic or political issue**. #### ✅ b. **Implied exculpatory evidence or procedural irregularities** Some of these witnesses (e.g. DSS DGs, Army Chiefs) may be called to: * Account for how Kanu was arrested or treated (e.g. **extraordinary rendition** from Kenya in 2021) * Confirm chain of custody, use of force, surveillance, etc. * Suggest possible breaches of **due process or fundamental rights** #### ✅ c. **Delay or tactical pressure** Requesting **90 days** and listing high-powered individuals may: * Apply **pressure on the state** (by forcing them to respond to calls involving politically sensitive actors) * Act as a **procedural delay** to slow down the trial * Potentially open space for **negotiation** or **public sympathy** #### ✅ d. **Public relations and legitimacy** Bringing powerful names into the courtroom may be an attempt to **legitimize** the defence narrative and create **public doubt** about the prosecution’s case—even if those witnesses never testify. --- ## 🧑⚖️ LIKELY REACTION OF THE COURT: Predictive outlook ### 🔸 1. **Skepticism about relevance** The court is likely to scrutinize: * **Relevance and admissibility** of each witness * Whether the person has **direct knowledge** relevant to the charges * Whether the witness testimony is **duplicative**, **speculative**, or intended for **theatrics** **Expect the judge to demand specificity**: What does each person know? What issue does it relate to? --- ### 🔸 2. **Concerns about delay** Courts—especially in **terrorism or national security cases**—are generally cautious about unnecessary delays. * The 90-day request may be **rejected or significantly reduced** unless each witness is shown to be material and realistically obtainable. * The court may order the defence to **prioritize** or **sequence** witnesses rather than list everyone at once. --- ### 🔸 3. **Restrictions on compellability** Some named individuals may **invoke official privilege**, **security confidentiality**, or **non-relevance** to resist testifying. The court may uphold this where: * Testimony would expose **classified or state-sensitive material** * The witness has no direct connection to the charges * There’s **no legal basis** to compel testimony (e.g. no subpoena served or insufficient foundation) --- ### 🔸 4. **Risk of judicial backlash if perceived as theatrical** If the court views the witness list as: * A **publicity stunt** * An attempt to **politicize** the proceedings * Or a **misuse of judicial time and process**… …it may: * Issue **strict evidentiary rulings** * Exclude irrelevant or redundant witnesses * **Sanction or caution** the defence if there's clear abuse --- ## 🎯 Final Thoughts: Strategic Pros & Cons | **Pros** | **Cons** | | --------------------------------------- | ------------------------------------------------- | | Signals serious political context | May be seen as stalling | | Draws public attention | Risk of hostile court response | | Raises human rights/due process issues | Hard to enforce subpoenas on high-ranking figures | | Forces state to respond on wider issues | Weakens focus on core legal defence if overplayed | --- ## 🧠 Strategic Advice (if hypothetical): * The defence would do well to **tighten its focus**, emphasizing only those witnesses who have **clear, direct, and admissible value** to the actual charges. * Avoid overreaching—**theatrics may backfire**, especially in high-stakes national security trials. * If politically sensitive witnesses are truly essential, the defence should **lay proper evidentiary foundations** and **prepare for privilege objections**. --- Let me know if you’d like a mock legal memo or a fictionalized court ruling predicting how a judge might respond. |

Nairaland lawyer, una funny for this forum sha. MNK is even using Nigerian government to advance the Biafran struggle from what I'm seeing. That dude is a genius. He is ready to spend 50 yrs in DSS custody if that will guarantee his struggle. I know you folks don't read but try read Mandela's book to get small sense of what is happening. DomPerignon: |
