Section 40 of the 1999 Nigerian Constitution provides for the right to freedom of association. It allows every individual to gather and associate freely with others. This includes the liberty to create or join political parties, trade unions, or any other group formed to protect their interests. Although this right is safeguarded, it is still subject to certain restrictions specified within the constitution.

In order for this right to be brought to an end, Section 40 of the 1999 Nigerian Constitution would have to be amended.

In as much as the mindless defections are becoming nauseating, this judgement is likely to be set aside by a superior court.

This is so because if this judgement is allowed to stand, it should be made to apply to all the others who had defected as well.

This looks like selective justice, if you ask me.

Why should the law apply only to the Representative of Zamfara State?

What's sauce to the goose is sauce for the gander.

Or is it different courts, different interpretation of the same law?

This matter must go to the final abiter of the law - the Supreme Court!

A political office holder can defect from his party without automatically losing his seat if he can prove that his defection was based on division or factional crisis within his original party. The Nigerian Constitution, particularly Section 68(1)(g) and 109(1)(g), provides that a legislator may retain his seat if the political party on whose platform he was elected becomes divided, merges with another, or if there is a faction within it. In court, such an office holder can defend himself by presenting evidence of internal conflicts, parallel congresses, or leadership disputes within his former party to justify that his defection was a reasonable and lawful response to instability. Courts have, in several precedents, upheld defections where genuine division was established, making the argument constitutionally sustainable.

He must appeal. The court is wrong. PDP is in crisies and that's a good ground for defection, constitutionally. A court just ordered PdP not to do national convention.

Even the US you use to flog Nigeria with, with your saner clime mantra , a Member of Parliament (MP) in the US does not automatically lose their seat if they switch parties; the decision is up to the MP, although there are occasional calls for them to resign or trigger a by-election. The MP has been elected to represent their constituents, and they are free to choose which party they align with.

Just because you are on the losing side does not mean you should pollute our nostrils with your body odour of hate and bile against the Nigeria government and most especially, against our President Bola Ahmed Tinubu, the JAGABAN.

That can't hold now, some judge with emotional judgement, when the party is not at peace any member can move the mandate is for the person not the party since he has paid the party to use her platform to run for the office, it was not the party that sponsored his campaign and electioneering activities

Yes, the mandate was never for PDP it was for him he has paid PDP for using their platform to bid for the office and it was him that sponsored his campaign and electioneering activities

Not about your country. The constitution states that if there is no problems in the party and a member who was elected on the platform of the party defected, the defected member automatically lost the position but in a situation of a tatered party like PDP, defected members have nothing to loose or fear because it's clear and glaring.

Listen a 5man panel of the Supreme Court cannot overturn decisions of a full Court.

The judgement preceding that was a Constitutional one and a full panel of 7 sat on it, it remains unimpeachable unlike the Rivers matter wherein 5 Judges sat. This is the confusion this SC has caused.
What are you saying?

The ability to overturn a decision is based on the court's position in the judicial hierarchy and its appellate jurisdiction, not solely on the number of judges on the bench.

But in this case,he was unable to prove to the law court with convincing evidence that there is internal crisis in his former party.Hence,the court vacated his seat.

The supreme Court has severally said that the votes belong to the party and not the candidate. How then can you carry the votes of party A and give party B? If people resign from A to party B when INEC gives nod for party primaries irrespect of 2027 general election, I can accept it.

Lol.. pls go and overturn it in a higher court shapally. The judge has collected money from ur political enemies. Efcc should trace where the money is. The constitution is clear: you can defect from a party if its in internal crisis. Even yesterday, the chairman of pdp was suspended by other factions. The party is in comatose, using external oxygen to breath. One judge having collected money is saying one thing. Overturn it immediately
