Both justice Awomolo and Omotosho are too small to intimidate Mazi NNAMDI Kanu with jail.
No Nigerian court has any jurisdiction to even think of trying Kanu and they know that, but just trying their lot if he could give in to their persecution but MNK is a man that knows the dictates of international law despite not been a lawyer. .
You can't stand under a state crime and want to prosecute an alleged crime. It can't happen so let the judges finish with their shenanigans and MNK will walk out free.

MNK knows he has a pretty bad case and that the best way out for him is to put up a false face of bravado.

Justice James Omotosho, being a seasoned judge, has opted to give him a last chance to put up his defense.

Failure to do so would be assumed as consent to the outcome of the decision of the court.

The trial judge, by tomorrow, would therefore proceed to give his final judgement and sentencing of the embattled and already court-wearied MNK.

If you know how legal proceedings are done you will realise they are silent because it is prejudice to talk when it is not appropriate. He should be the one to know which law applies and he has decided he is competent to defend himself.

Federal High Court, Abuja – Hon. Justice James Omotosho
Tuesday, November 4, 2025

KANU HAS NO VALID LIVING OR EXTANT CHARGE AGAINST HIM. NONE. ZERO. NULLITY.

THE ENTIRE CHARGE SHEET IS A LEGAL CORPSE — REPEALED, NON-EXISTENT, AND UNAMENDED IN OPEN DEFIANCE OF A SUPREME COURT ORDER.
That is not opinion.
That is black-letter law.
That is Section 36(12) CFRN 1999.
That is the Supreme Court judgment of 15 December 2023.
That is the truth the judge refused to acknowledge today.

PLAIN ENGLISH: WHAT ACTUALLY HAPPENED IN COURT – WITH REAL EXCHANGES
Kanu appeared in court, stood up, and represented himself. The courtroom was full, tense, and expectant.

1. Kanu: “My Lord, there is no charge before this court.”
Kanu immediately adopted his Motion on Notice filed on 30 October 2025, and said:

“My Lord, this court lacks jurisdiction. There is no charge against me that exists in any current Nigerian statute. I ask that the court strikes it out today.”

He requested a ruling immediately.

2. Judge refuses to rule, calls the application “not final.”
Justice Omotosho responded:

“This is not a final address. The court will take your motion at the appropriate stage.”

Kanu replied firmly:

“Jurisdiction is taken first, My Lord. Without a charge, there can be no stage.”

3. Kanu reads the Supreme Court judgment aloud in court.
Kanu opened the certified judgment of the Supreme Court (15 Dec 2023) and read the famous paragraph of Garba JSC:

“Count 15 does not exist in the body of Nigerian laws. It is unknown to our law. The prosecution must amend it.”

He looked directly at the prosecution bench:

“You were ordered to amend it. You disobeyed. Yet you forced me to plead to a count that does NOT exist. That alone nullifies this entire proceeding.”

4. Prosecution caught flat-footed – no law cited

Kanu turned to Awomolo, SAN:

“Learned Silk, please tell this court the extant written law I allegedly broke.”

Awomolo SAN paused, shuffled his papers, and remained silent.

The court gallery murmured.

Kanu repeated slowly:

“Just one law. The name, section, and statute in force today.”

Still no answer.

5. Kanu invokes Section 36(12) – the constitutional kill-switch

Kanu: “Section 36(12) is clear. No person shall be tried or convicted for any offence not defined in a written law. No written law = no offence = no charge = no trial = no detention. I should not be here, My Lord.”

Judge Omotosho replied:

“That provision applies at the point of conviction, not trial.”

Kanu shot back instantly:

“My Lord, respectfully, that is wrong. The moment the law dies, jurisdiction dies. The trial cannot begin. It is a nullity ab initio.”

6. Kanu cites global case law
Kanu raised his voice slightly and cited Lord Camden’s historic ruling in Entick v. Carrington (1765):

“If the offence is not found in our law books, it is not law.”

He added:

“My Lord must take judicial notice of the repeal. That is the Evidence Act, Section 122.”

Judge did not respond to the legal point.

7. Court tries to force defence to begin

Justice Omotosho: “Mr. Kanu, are you ready to open your defence or not?”

Kanu: “I will open my defence now — this minute — if you show me the extant law under which I am charged.”

Court fell silent.

8. Awomolo SAN attempts an attack — and fails
Awomolo SAN rose: “He is wasting the time of the court. He should proceed to his defence.”

Kanu faced him squarely: “Senior Advocate, you accuse me of wasting time? Produce the law. If you show it to me, I will enter the dock this second. Let the world hear it.”

Awomolo SAN sat down. Silent.

Observers whisper: “Checkmate.”

9. Kanu accuses the court of denying fair hearing

Kanu:“This is constructive denial of fair hearing. You refuse to acknowledge the repeal of the law, refuse to obey the Supreme Court, refuse judicial notice. That is persecution, not a trial.”

Court did not challenge the statement.

Adjournment

The court adjourned to: Wednesday, November 5, 2025 For Kanu to “enter defence or waive it.”

Kanu maintained his position: “No law, no trial.”

Dont you get it, did you read the script at all?

Police arrested you and charged you for stealing your own money or giving you wife doggy... and youre being forced to defend yourself in court, what do they want you to defend your self on? The vase is baseless, can you steal what belong to you? Aquaute and discharge this case and free the guy, simple!

It is clear, all of these is just a political show of shame and charade, the continuous detention of this guy will cause more trouble for Nigeria and unrest. Let the guy go

Why is the judge threatening NK with last chance? NK is not the type that chicken out. Buhari offered him everything he refuse so threatening him with last chance is nothing to him.

He has repeatedly said he has no case to answer and no competent court in Nigeria has the right to trail him. Which law is Nigeria government is going to use to trial him?

Simple. You just summarised the whole scenario behind this trial.

One has maintained his stand that "NO LAW = NO TRIAL", and the court is beating around the bush, claiming they are giving him last chance.

The court knows that they don't have any case against MNK, that's why they are forcing him to open his defence. The court is just beating around the bush.

If the court had valid case/charges against MNK, they'd have tried and sentenced him long before now.

My happiness is that this issue of Nigeria government and MNK trial, has drawn the attention of the international bodies.

Make I see which law them go use trial and sentence MNK.

If Nigerians can leave emotions aside, they will know that this guy has no case to answer. But most people just hate him for no just cause.

Let's even say he did all that FG is accusing him of, MNK is saying you can't try him on illegality. The way he was brought into the country makes a mess of whatever they want to try him on....simple!

The first thing in a criminal trial is the government outlining all charges before the court and to which the defendant is expected to enter a plea as each charge is read out.

Kanu has already entered a plea of Not Guilty under Justice Omotosho after the case was handed to him.

To say no law exists in line with the charges right now after already entering a not guilty plea is ludicrous.

Kanu is searching for future grounds of Appeal to overturn the inevitable guilty verdict and he is attempting to create technical grounds by refusing to enter his defense on the grounds that he did not have a fair hearing that the judge ought to have assigned a lawyer to him who would have entered his final defense.

The problem the Govt has with this case is that it is a jamboree..

Even the judges handling this case are scared for themselves and for posterity..

The FG made a case against MNK difficult when it enjoyed releasing known terrorists and proud bandits in the the North. The FG even goes far enough to absorb them into our Armed forces.

If you can release Islamic terrorists and bandits who even have TikTok accounts, why are you keeping this man in jail with this jamboree, sit-today-adjourn-tommorow case. This is the question IPOB lobbyists are telling world powers to put before Tinubu and the FG..

The case has gone even beyond the judges and Tinubu himself. A case of the devil and the deep blue sea. grin
