PUBLIC BRIEFING NOTE: 07.11.2025.

TODAY’S EPIC BATTLE BETWEEN MAZI NNAMDI KANU & JUSTICE JAMES OMOTOSHO AT ABUJA FEDERAL HIGH COURT

Issued by: Onyedikachi Ifedi, Esq. (reporting from a tense courtroom)

1. Overview of Today’s Shocking Court Developments
The electrifying proceedings in the case of Federal Republic of Nigeria v Mazi Nnamdi Kanu before Justice James Omotosho took a disturbing turn today, raising serious public concern over the integrity of the judicial process. Multiple actions and pronouncements made by the presiding judge have been widely described as unprecedented, hostile to fair hearing, and blatantly contrary to constitutional standards of criminal trial.

2. Judge Unable to State the Law Under Which Kanu Is Being Tried
In open court today, Mazi Nnamdi Kanu demanded repeatedly that Justice Omotosho identify the specific written law under which he is being tried.

Despite multiple direct requests, Justice Omotosho could not cite any written law creating the alleged offence. Instead of addressing this foundational constitutional requirement, the judge evaded the question.

For the avoidance of doubt, Section 36(12) of the 1999 Constitution (as amended) provides:

“A person shall not be convicted of a criminal offence unless that offence is defined and the penalty therefor is prescribed in a written law.”

Kanu made it clear to the court that no conviction can stand without a valid written law, and that his faith is on Section 36(12) of the Constitution, not on the judge’s personal views.

3. Judge Failed to Acknowledge the Use of a Repealed Law
Kanu moved a formal motion to expunge his plea from the court record on the grounds that the charge was founded on a repealed law.

Rather than taking judicial notice—something every judge is bound to do under the Evidence Act—Justice Omotosho sidestepped the issue. The court refused to acknowledge that no one can be tried under a repealed statute, a position anchored in Nigerian and international law.

4. Omotosho Blocks Final Written Addresses – A Disturbing First in Nigerian Criminal Trial History
In a move that has stunned legal observers nationwide, Justice Omotosho announced that he does not want any final written addresses from either party.

This is widely viewed as an aberration and a dangerous departure from established criminal procedure. Final written addresses are:

A core component of fair trial
A mandatory stage before judgment
The primary avenue for defendants to challenge evidence and raise points of law
No credible record exists of a trial judge in Nigeria deliberately blocking final addresses in a criminal case. Legal commentators have described this as a judicial ambush.

5. Kanu’s Final Word to the Judge Today
In response to the judge’s position, Mazi Nnamdi Kanu told the court that he does not care what Justice Omotosho says, because the Constitution is supreme:

He stated clearly that Section 36(12) CFRN forbids any conviction without a valid written law, and that no court can override the Constitution.

6. Public Concerns and Implications
Today’s proceedings raise grave questions:

Why is a judge avoiding reference to the law he claims to be applying?
Why refuse written addresses unless the goal is to avoid legal scrutiny of a predetermined outcome?
Why is a court entertaining charges tied to a repealed law?
These developments undermine public trust in the judiciary, and today’s events have intensified public, legal, and international concern over the fairness of this trial.

Conclusion

What transpired in court today is not a normal judicial process. The actions and statements of Justice James Omotosho reflect a troubling pattern of procedural irregularities, disregard for constitutional safeguards, and hostility to fair hearing.

This briefing is being issued in the public interest to ensure transparency and to document the concerning conduct observed in today’s proceedings.

More details later...
Just cool temper.

I could read the mind of the judge:

No need to waste time on final written addresses because Kanu has no case to answer.

You can take this to the bank, whilst we wait for final judgement!

Exactly!
It is the job of the prosecution to tell Kanu, the defendant the law he has broken and by making their submission to the court.
They already made their submission. They have no reason to reply Kanu unless he opens his defence. There're procedures in court. The prosecutor can only respond when Kanu opens his defence because whatever Kanu has been saying will be expunged from the judgement. It is not part of it.

This is the aspect of Kanu's blind support by SOME Igbos that I find utterly baffling. Kanu's gunmen have killed so many Igbo people whose only crime was trying to get out of their homes on Mondays, in defiance of Kanu's illegal orders that FORBADE them from going outdoors.

Despite that direct involvement in the killing of Igbo people, many of the same Igbo people STILL worship that killer as though he is a deity.

Anyway, not worry, Kanu will rot in jail and will soon be forgotten in exactly the same way that Simon Ekpa has become a mere footnote of past irrelevant history, as he languishes in a Finnish jail from where Mr. Ekpa will be DEPORTED to face ANOTHER jail sentence in Nigeria.
Bro kanu dey against d sit at home plus his whole family members....try n find out facts always...na Simon ekpa instigate dat Monday sit home n kanus family has tried severally to stop it but it's hard to stop cos kanu dey locked up...try to get ur facts my brother before u guys jump into wrong assumptions

Nnamdi Kanu is indeed God sent, he is a true hero against injustice.... he has finally won the battle against his oppressors. Today, he has proven to the whole world that Nigeria is an unjust lawless country. Justice Omotosho should bury his head in shame for supporting illegality, putting Nigeria judiciary in to total shame.... if Nigeria wants to kill him so be it but let it be known that this injustice will not end with Nnamdi Kanu.... Nigerians supporting this injustice should bury their heads in shame.... Nigeria is a zoo....
Which injustice are you referring to? Is it for the people who Nnamdi Kanu ordered his boys to kill before and during end sars or the army officer couple he had killed in imo state or the the policemen he said should be killed anywhere they find them or the property he had burnt or the people he terrorized to remain indoors on Mondays?

I thought you were all claiming he had strategy naming everyone except the trial judge as his witnesses. Nnamdi Kanu behaves like a fool because the Bible said anger resides on the lap of a fool and Nnamdi Kanu seems to carry it on his head grin prideful and arrogant man who can only be inspirational to people of low IQ like him. Nnamdi Kanu shall never know peace except he brings back all the people he had killed for an agitation that's designed to scam people of their money.

Igboro was well protected by Yoruba elders...Igbo elders should have done the same for kanu...but because money was not involved...they did not do it..that's why this man find himself in this messy situation
truthera:
I don't blame you. Let all igbos learn from what is been done to Nnamdi Kanu today by zoo Nigeria. Would justice Omotosho disregard the constitution if it was a yoruba man in his dock? The answer is NO.... The injustice against igbos will continue, this is why igbos need to come together and demand their exit from Nigeria... This country is finished....

Kudje prison loading. This is why you need a lawyer to articulate your case

Kanu needs a course in anger management. Insulting everyone insulting blacks does not buy you favours. Keep speaking your truth and you will be heard.

Simon Ekpa used the same defence in Finland and he was jailed.

Will you shout at a judge in the UK even if you don't agree with their judgement? NO It is contempt of court. You have not even been sentenced and you are yelling on your presumption

Nnamdi Kanu and empty theatrics. Playing to the gallery and creating content for his circus of IPOB minions as usual. Failing to provide any legalese to back up his stand as usual.
Novemberv20th is judgement day and a rude awakening for Nnamdi Kanu,Biafra and his IPOB minions.

Just watch the video below of Kanu ranting and raving without proving a single legal point or defence of his charge sheet.....lol...😁😆😊

Look at this useless lame duck. You want him to keep quiet while they heap brimstone on him, and at the end of the day, you claim there was a trial.
The days of reckoning will come, and soon that will be.

So that means he should act uncivilized…

Can he try that outside the country and he won’t be punished?

Even Biden and Trump won’t do that in court of law.

And what’s all those racist stuffs he’s saying right in the court of law and to the public

If the judge doesn’t charge him for contempt of court and use of racists slurs, then the court don’t know what they are doing
No judge outside the country can try what the corrupt judge is doing. Where in the world do you judge somebody without a law?? In a sane country that Injustice Omotosho should be languishing in prison by now.

Why do the lawyers quote different sections of the constitution while defending a client or trying to prove a statement of fact?

The constitution is what guides and determines when someone has done something wrong and who is a guilty party.

You can't convict someone if the constitution doesn't make provision for it.

I know you hate the man and probably Igbos by extension but your constitution has a loophole that needs to be addressed. He found the loophole and that makes it impossible to convict him.

I just love the courage, wisdom and audacity of this guy.

These are the type of people needed to truly force a positive change in a nation by telling truth to power without fear of any consequences.

I salute you Mazi Nnamdi Kanu. What you are doing transcends just Justice for Igbos, it is a battle to institutionalise Justice, equity and fairness in the nation Nigeria, and to awaken citizens to their rights and privileges as enshrined in the constitution.

After all the shout and insult, he will still be packaged back to Kuje.

Instead of defending himself, he is shouting, claiming knowledge of the law more than anyone else. The court is now free to give its verdict, ten thousand of Trump won't save his arsss.
Poor logic.
If he wasn't vocal, he would have been long convicted by Justice Binta Nyako.
