We cant be appealing to a judge who has ruled. That makes no sense.

If you had listened to the Judge, he alluded to it, when sentencing Kanu. He emphatically said, Kanu didn't comport himself well throughout his trial... And he had no choice than to convict him accordingly.

But I think his failure to mount defence ( no matter how ridiculous) in the lower court, will inadvertently affect the success of his appeal... But I am not a lawyer... You can guide me further on this observation.

or he might also get death sentence. Appeal court may overrule what high court ruled and hand him a death sentence which is what the constitution stipulates

Appeal Court will not rule as a steep over the High Court.
They either reduce it or leave it as you were.

The judge must have considered some factors before giving Kanu a life imprisonment sentence.

The FG should just appeal the judgement, the appeal court would definitely quash the life imprisonment sentence

I am checking the Terrorism Prevention Amendment Act 2011, most of what I am seeing here is life imprisonment, unless you have the recent one.

i agree. the reality is no prisoner has been executed since the return of democracy so it makes no difference in actual implementation but I agree it should have been death sentence even if it would never materialize.
