In a dramatic legal twist, Mazi Nnamdi Kanu’s decision to disband his legal team and defend himself in court has turned heads and may yet prove to be the most astute strategy of his life. Legal luminary Victor Ukutt argues that Kanu’s move was not impulsive or reckless, but a well-calculated gambit. According to Ukutt, once his lawyers sensed that securing his acquittal was unlikely, they may have quietly concluded that their efforts would be futile. By firing them, Kanu forced the court into a high-stakes constitutional minefield, one that could ultimately undermine any conviction handed down at trial. Under Nigerian law, when an accused faces a capital offence or an offence that carries life imprisonment, the court has a statutory duty to ensure he is defended by a legal practitioner at all trial stages. The Criminal Procedure Act, section 352, for instance, provides that if the accused has no counsel, the court must assign one, if practicable. Similarly, students of criminal justice note that where life imprisonment or the death penalty is in play, self-representation is barred under certain circumstances. Further, the Administration of Criminal Justice Act (ACJA) 2015 strengthens this safeguard. Section 349(6)(b) expressly states that a defendant charged with a capital offence or one punishable by life imprisonment “shall not be allowed to represent and defend himself in person.” Courts are required to inform any self-represented defendant of his constitutional rights, including the serious risk of proceeding without counsel. Ukutt suggests that Kanu’s move laid a “booby trap” for the trial court. With no lawyer on his side, Kanu subtly challenged the court’s ability, even its mandatory obligation, to continue without formally assigning him counsel. The prosecution apparently did not spotlight the trap, and the trial court, in its haste, rushed to judgment without addressing what may be a deeply fundamental error: lack of legally qualified representation. If Ukutt’s reading is correct, the appellate courts (the Court of Appeal, perhaps even the Supreme Court) could rebuke the trial court. Given established Nigerian jurisprudence, a conviction under such circumstances may be declared null and void, potentially freeing Kanu on appeal. Indeed, in previous rulings, Nigeria’s highest courts have insisted that denying an unrepresented defendant counsel in a capital case violates Section 36(1) of the 1999 Constitution, which guarantees the right to a fair hearing. If these safeguards were breached in Kanu’s trial, his victory might just come next year not through acquittal on the merits, but through a procedural rebuke. Ukutt warns that those already celebrating his potential incarceration should hold their applause. Should Kanu escape on appeal, no politician or partisan actor, should claim credit. His release, he says, would not be thanks to political patronage but to legal acumen. In the end, Nnamdi Kanu may yet prove that the sharpest weapon in his arsenal was not his speech or his ideology but his lawyerly strategy.

As in many of una boast, this too will be futile and wishful. The sound judgement handed out will be upheld up to the supreme court. His only option is to open defence, plead for more leniency otherwise sorry will remain his surname. Every other calculation will simply be hallucination! |

Immatex:Did you understand the fundamental error unraveled in the post? If a mistake is made by the bench of juries in any jurisprudence, then the Verdict of the sentence is null and void. The only concern here is that Nigeria is a lawless country. Even though this legal procedural requirement of being represented by a qualified lawyer is mandatory, any powerful person can upturn it. Nigeria is not a country to rely on any ground. |
