Benin Republic Jet Invasion: Did Tinubu Got Approval Of Senate by Nextjs(op):
Section 5(4)(b) states: “Except with the prior approval of the Senate, no member of the armed forces of the Federation shall be deployed on combat duty outside Nigeria.”


Taking military action against Benin republic internal crisis with out first sending a debate to the Senate for approval of such action is a violation of the constitution. An impeachable offence.

Question we need to ask :

1) Did the situation innBenin republic qualify as an “imminent threat or danger” to Nigeria’s national security?

2) did the President subsequently seek Senate consent (within 7 days), and did the Senate act within 14 days? That is a strict constitutional requirement


If the above couldn't be answered then there is a reasonable argument that the deployment to Benin republic could be a violation of section 5 of our constitution


Even Trump had to engage the US Senate after his threat to Nigeria

It was an emergency deployment to protect a possible security threat to the country and it was done under strict ECOWAS convention.

This is a non-issue. The constitution is not a trap for the president to fall into.

If Tinubu made a move to help Benin Republic, I trust he has the interest of Nigeria at heart and would have done it legally.

That's Nigeria internal crisis and can be handled internally but invading another country airspace irrespective of anything the sanate must be notified

ECOWAS treaties do not automatically become part of Nigerian domestic law unless the National Assembly enacts them into law

Under Nigerian law, the Constitution is supreme.

Here is what your constitution says
Section 1(1) – “This Constitution is supreme and its provisions shall have binding force on all authorities and persons throughout the Federal Republic of Nigeria.”

Section 1(3) – “If any other law is inconsistent with the provisions of this Constitution, this Constitution shall prevail, and that other law shall, to the extent of the inconsistency, be void.”

Section 12(1) – “No treaty between the Federation and any other country shall have the force of law except to the extent to which any such treaty has been enacted into law by the National Assembly

Emergency is what you are missing. Nigeria soldiers was deployed to Liberia when Charles Taylor was going through trial at ICC. The process takes time to be ready.

Incase of Benin, it's a coup which is emergency

A coup is undergoing at neighbouring country, the closest country to Nigeria. Or have you not been to Idi Iroko , Badagry area before?

Unrest in Benin will make their people to flee to Nigeria and cause inconvenience. If you were to be the Nigeria president, would you have allowed that?

I believe that the situation in Benin Republic qualifies as an imminent threat to Nigeria's national security. So far, there has been no military deployment to Benin Republic and I believe that the President will seek the Senate's approval if the need arises.

I find it hard to believe that even in this day and age, we still have people who think that a country can just sit back and wait for a threat to materialize before taking action.

Unrest in Borno, and all North East state made Nigerians flee to Cameron, Chad, Niger. Today we have idp camps scattered all over this neighbouring countries
