This is very untrue.
He didn't participate in the Primary, hence PDP cannot institute any case against him.

Again, issues of nomination is a pre-election matter

The above citation negates nomination in two election. or same election from two parties.
In the case of Shetimma Vrs PDP 2024,the Apex Court ruled the cahkaenge of Shetimma by PDP as a person who contested Senate seat for Borno Central and later as the Vice President should have ve been tendered by a person who took part in the APC primary not PDP .

However if it is a post election matter any part that took part in the election election could institute the case..

The case was struck out by the FHC ,AC and SC for la lacking merit and poor prosecution.

As for Adeleke his name appeares on the PDP Primary .In fact his withdrawa letter from PDP was dated December 4 that is after the primary.

PDP can institute while any party that will contest with Accord can also insistutte the case as a post election matter.
Section 29(5):
Any Aspirant who participated in the primaries of his political party who has reasonable grounds to believe that any information given by his political party’s candidate in the affidavit or any document submitted by that candidate in relation to his constitutional requirements to contest the election is false, may file a suit at the Federal High Court against that candidate seeking that the information contained in the affidavit is false.”

Meaning only an aspirant not a political party can sue Adeleke (if any)
The question to ask is: who is suing? Fryo?
Fryo won the Primaries, so what is he suing for?

Again, who is an aspirant? Is Adeleke an aspirant having participated in the screening but not in the Primary? Don't forget, he resigned on November 4, 2025.

Section 87(1)
“A political party seeking to nominate candidates for elections under this Act shall hold primaries for aspirants to all elective posts.”

Did Adeleke participate in the primary of the PDP?
The Supreme Court in Professor Onyebuchi Chukwu Vs Dave Umahi (2016) held that an aspirant is:

1. One who purchased the expression and nomination forms
2. Participated in the screening process of the party & is successful
3. Physically present and cleared on the day of the Primary.

Again, the Supreme Court in Daniel Vs INEC (2015), held thus:-
By the provision in Section 87(9) of the Electoral Act 2010 (as amended) it is an aggrieved aspirant who physically participated in a primary election conducted by the National Executive Committee of his party that is imbued with the locus standi to raise a finger of complaint... The Appellant admitted that he did not participate in the primary. He is not an aspirant in terms of Section 87(9) of the Electoral Act. He is not imbued with the locus standi to challenge the said primary."

The questions now are:-
Did Adeleke physically participate in the said PDP Primary?
Did Adeleke withdraw before the Primary?

THERE YOU HAVE THE ANSWERS....
Again, this is a pre-election and not a post-election matter.

Defect to where, they rejected him from joining when he wanted to join them. They also chased him out of PDP, same for ADC. If he was special, TOP POLITICAL PARTIES would have been rushing him. He probably has no electoral value in osun.

All I can say at this stage is to wish him well.. Of course PDP is no longer a party that can deliver such a re-election ambition (at lead at the moment) and he can't go to APC... His best bet is Accord Parry.
