Governor Adeleke Joins Accord on a Wrong Footing: Legal and Political Risks Ahead

Governor Ademola Adeleke’s recent move to join the Accord Party has generated intense debate, not because of the decision itself, but because of the faction he aligned with. The Accord Party, for months, has been deeply fractionalized, with Bar. Maxwell Ndubem and Prof. Chris Imumolen both laying claim to the national chairmanship.

In October 2024, the FCT High Court issued a clear judgment recognizing Prof. Chris Imumolen as the authentic National Chairman of the Accord Party. Despite this judicial pronouncement, INEC has yet to fully comply with the court’s order, creating a situation where two factions continue to operate in parallel.

Governor Adeleke reportedly joined the faction led by Bar. Maxwell Ndubem, a group considered by some as “recognized” by INEC, yet legally inferior in standing when compared to the court-backed leadership of Prof. Chris Imumolen. This puts Governor Adeleke's political move on shaky legal ground.

Analysts warn that this misalignment may carry serious political consequences. When did Adeleke joined and become a member of Accord party?

I may be wrong sha, but if I am correct, APC just need to work hard to at least come second, Adeleke will be disqualified last last.

Did you see how INEC rushed to monitor the party Congress that announced his defection.. because it's a small, inconsequential, non-threatening party..because if it were a big party he's defecting to, they would start asking for permission from you-know-who..🤔🤔

In a well-conducted National Convention attended by INEC, Maxwell Mgbudem was elected National Chairman. In July 2024. A faction led by Chris, the 2023 Presidential Candidate planned a coup to remove the Chair but failed. However, they procured an FCT High Court judgement on August 30, 2024 affirming Chris via an exparte order.

Two things are wrong with this judgement:
The case was filed on August 26 via exparte and Justice M M Adamu miraculously ruled on the exparte four days later. Expartes have a finite timeline of 7 or 14 days at the maximum.

Again, the Supreme Court has said many times that leadership of a political party is within the internal affairs of that Party, hence the Courts have no jurisdiction whatsoever to adjudicate thereof.

INEC continues to recognize Maxwell. On November 2024, the NEC led by Maxwell expelled Chris and his co-travellers.

I have looked at this case from every possible viewpoint and do back INEC in the recognition of Maxwell, others can go to Court where I know they will get no reprieve. There is no faction in Accord Party, the Party is on solid ground.

Adeleke didn't participate in the PDP Primary.

He duly resigned from the PDP on November 4 and joined the Accord Party on November 6.

That is within the internal organs of the Party. Only an aspirant in the primary can challenge that. Unfortunately, he was the only contestant.

Again, parties have positions in their Constitution for waivers. Accord Party has one and duly granted same to Imole.
