ADC: Court Dismisses Suit Challenging David Mark, Aregbesola, Others Leadership by Bobloco(op): 1:09am On Mar 07
A Federal High Court sitting in Abuja has dismissed a suit seeking removal Senator David Mark and former Governor Rauf Aregbesola as National Chairman and National Secretary of the African Democratic Congress (ADC).

Justice Joyce Abdulmalik in her judgment that was delivered yesterday dismissed the suit on the ground that it bordered on the internal affairs of party to which the court has no jurisdiction to delve into it.


While the former Senate President, Mark, is the current national chairman of ADC, Aregbesola is the national secretary of the party.

In her judgment in the suit marked: FHC/ABJ/CS/13331/2025, filed by Dumebi Kachikwu and four others, Justice Joyce Abdulmalik upheld the preliminary objections filed by counsel for the ADC, Senator David Mark, and Rauf Aregbesola.

The court held that the issues raised to the leadership and membership of the party, are matters that are non-justiciable, and accordingly declined jurisdiction.

Listed as defendants are; the African Democratic Congress, Senator David Mark, Rauf Aregbesola, the Independent National Electoral Commission, and Chief Ralph Nwosu as first to fifth defendants.

Justice Abdulmalik held that membership and leadership of a political party is voluntary on the ground that parties are voluntary associations that have no compulsion

There was serious protests against her and she is one of the 'Wike' judges so she succumbed.

A similar case with the PDP last year, she ruled in favour of the Wike faction.

I think the judgement is faulty. The tenure of the former exco ended since 4 years and they remained in position. Even Abure whose tenures ended and conducted an election was later removed. I think the appeal or SC will say otherwise because you really can't build something on nothing.

It doesn't bother me. You know why? It's the Govs that are defecting that can explain themselves.

Tinubu was the only Gov of AC for 4 years and Obasanjo did everything possible to make him defect to PDP, Obasanjo intimidated, frustrated him and denied Lagos State its Allocations yet Tinubu stood his ground.

The rest is history today. So let the Govs tell Nigeria and Nigerians what is pushing them around.

Anyway is a way wether forming a new party or hijacking an existing party as long as no crime was committed in the process. The supreme court has made it very clear several times that courts has no business in the internal affairs of political parties so on what basis is the appeal court going to rule against this judgment.

The former pdp governors obviously saw how tinibu and wike is using the judiciary to destroy the pdp and knew that getting a second term in office while still in the pdp is becoming almost impossible that's obviously why they are all defecting other top politicians are defecting to avoid prosecution watch them all defect back to the pdp immediately the apc loose next year's presidential election. There's no ideological alignment just political survival.
