No Legal or constitutional basis detaining El-Rufai Interminably - Odinkalu by fergie001(mod):
As @GovKaduna, @elrufai was lawless. I disagreed with him then. Today, he is being treated as beneath the law. I disagree with that too.

I call @elrufai a #VileLittleMan. But the rights in the constitution of #Nigeria are not meant to protect merely people whom we like or agree with. No one in #Nigeria shd be above the law or beneath it.

The constitution is clear on the standards of pre-trial detention. And it prohibits administrative detention

If @icpcnigeria, @OfficialDSSNG or whoever else is holding him have crimes against him which are tenable in court, they shd charge him to court.

Whatever happens, there is no legal basis or justification for keeping him or anyone in detention interminably. That is keeping a citizen beneath the law. It is unlawful, unjustifiable & unconstitutional.
Professor Chidi Odinkalu
A former Chairman, National Human Rights Commission

Elrufai is squeaky clean. The so-called "fighters of democracy" and Paul Biya wannabe have been unravelled as they have since surpassed Sani Abacha in all vices. Next, will be a continuation of media trials on pages of their well-oiled Lagos-Ibadan Expressway toilet papers. All while avoiding the courts as Nigerians have been demanding. Their goal is to keep Elrufai out of the 2027 electioneering campaign knowing his capacity but that will not change the inevitable outcome. The tables will turn in a jiffy.

I can only but imagine what El Rifai would have done to the person who did exactly what he did if he were to be the president today.

What exactly did he do? If it's about the wiretapping charade, what really is ICPC's business raiding his residence and confiscating laptops, flashdrives and Nokia N95 and asserting them as wiretapping tools? Is that part of their core mandate? The laughable wiretapping case by the DSS was scheduled to be heard in court but the ICPC failed to produce him. This is a gross abuse of office and we know who's calling the shots and for what reasons but they are only setting a dangerous precedence and the tables will turn in a year from now. Neither the ICPC, DSS or EFCC are a court of law and they are keeping Elrufai illegally in detention against the dictates of the Constitution. That's what Chidi Odinkalu is trying to tell you in the original post. Elrufai has never detained anyone extrajudicially without them having their day in court.

Aminda, take heart.
From reducing Kwankwaso to someone who is begging, to Atiku being able to secure only 7 votes and now Elrufai caged like a guinea pig.
I really feel for you.

Why are the ADC guys not speaking up for Elrufai?

What do they know that is keeping them quiet?

Normal legality or strict adherence to due process Odinkalu cites is null and void over matters of serious threats to national security.

El Rufai can legally be detained for a long time as it is the right of our security leaders to do so.

I don't see how opposition will win because APC will not play clean like Jonathan. This people are desperate. And ADC isn't even playing opposition the right way with all the advantages they have, all the kidnapping and terrorism and hunger. Look at APC 2014

I think that man El-Rufai Nasir should be learning his lessons by now that you can't just believe you see everything and you can say anything and insinuate anything whether it's propaganda or the truth. There's the place of wisdom deployment always.

Now he has to depend on rigging.. and funny he can only rig where he’s liked..
let Obi deputized Atiku and let see how tinubu will rig election even in southwest

Thousands are languishing in detention, is he bigger than they.

When he was the governor, he caused many to be detained without trial

It's pay back time.

Go chuck your mouth for another thing.

Your enemy may say the truth more than your friends because they don't like you in the first place so they have nothing to lose in the fight. This is why you need enemies, don't surround yourself with sycophants and praise singers. They will run at the slightest bang.

I watched the interview two weeks ago.

Re: No Legal or constitutional basis detaining El-Rufai Interminably - Odinkalu by hotseat: 10:16am On Mar 09
El-Rufai, aka Hell Ruffian is having a dose of his own medicine.

If only he knew that there would be a time like this, he would have been more humane in the way he treated his opponents when he held sway.

He acted in ways that portrayed him as being above the laws of the land as he embarked on political brinkmanship in the name of being a member of the opposition.

His case with the FGN is hydra-headed viz:

1) Corruption, as petitioned by the Kaduna State House of Assembly and brought before the EFCC.

2) His confession on national television of tapping the phone lines of the NSA, being handled by the DSS.

3) His allegation that the ONSA is involved in the importation of thallium sulphate (a highly poisonous substance), also being investigated by the DSS.

This being the case, the relevant authorities are carrying out very diligent investigations after having the permission of the courts to have him detained for a period of two weeks as a first instance.

Pikin wey say e mama no go sleep, him too no go sleep.

He will surely have his day in court!

First things first!

El-Rufai is a crook and a wicked midget. However, the truth must said regardless of who profits or loses.

Prof. Odinkalu is a man of intellectual plenipotential and a respected scholar with Tufts University in the USA.

His integrity is as constant as the Northern star and the Eastern sunrise.

Gbadomudeens are not worthy enough to tie his shoelace. They are far too lowly down the totem pole of humanity..

Agreed that the ICPC is wrong for detaining him illegally, you cannot pretend to forget that El Rufai was vindictive during his time as a governor.
