Appeal Court bars INEC from validating PDP's Ibadan National Convention by fergie001(mod):
The Appeal Court sitting in Abuja has upheld the Federal High Court judgement stopping the PDP National Convention held in Ibadan. The Appeal Court consolidated all nine appeals emanating from the National Convention.

The three-member panel, chaired by Justice Mohammed Ambi-Usi Danjuma, with Hon. Justices Uchechukwu Onyemenam and Muhammed Mustapha as members, delivered a unanimous ruling dismissing the appeal and awarding a fine of N2 million against the appellants.

In its judgment, the appellate court upheld the ruling of the Federal High Court, which had nullified the controversial Ibadan convention.

The Court of Appeal further held that where a political party fails or refuses to conduct its congresses or conventions in accordance with its own constitution and the provisions of the Electoral Act, such matters can no longer be regarded as purely internal affairs of the party. Instead, they become subject to judicial scrutiny.

The court emphasized that any congress or convention conducted in violation of the party’s constitution and the relevant provisions of the Electoral Act cannot stand in the eyes of the law, as such processes undermine both internal party democracy and the legal framework governing political parties.

This judgement is a terrible twist and must not be allowed to stand .

The criminal legal system being operated by APC is very dangerous.

If PDP had behaved this way ,all the legal battles ACN won in South west that made them and Tinubu gather some strength to form a good opposition wouldn't happen so why are they using court to kill and destroy democracy in Nigeria?

Why will they call something that is white black ?

This is a disgrace

But if same thing happens in APC ,the court will rule in favour of APC that it's an internal APC affairs so court can not interfere


What a country

So we now have two different laws
One that must destroy opposition
And
One that must support APC

The Appeal Court also upheld the suspension of Anyanwu, etc who were earlier suspended by the Damagum-Executive.

This invariably means their own leadership who has these suspended leaders are also not in-charge. Party will likely be headed by BoT/NEC.

Why are you singling wike out, what about makinde that is using ibadan judiciary to detail judgement. What's the existing judgement before the ibadan convention. Emotion and fact are two different things

However, anyone with sense in their head would know that there was no way the Ibadan PDP convention could have been upheld.

This is really good ruling for the PDP.
FAIR ENOUGH, Samuel annyawu also suspended, which now clearly allows BOT to take over the day to day running of the party.

I really pity Nigeria Judiciary especially on political cases the same Appeal court that gave the two PDP factions chance to settle out of court amicably is the one being blamed by the loosing faction supporters.

The judgement did not invalidate the existing Mohammed AbdulRahman led NWC. The national caretaker committee stands.

Except one allows emotions to override objectivity, then one can begin to question the judgement of the Court of Appeal.

Even a layman can see that the Ibadan court acted in error by validating the jamboree called national convention held in Ibadan.

Wike would continue to win cases against his political opponents because there's always a method to his madness - he often acts within the ambit of the law.

When a Party's EXCO has its tenure expired, the Board of Trustees/NEC of the Party takes over.

All those who have followed Elrufai over the years know that Elrufai is not a fan of Tinubu

But when Tinubu was nominated as the candidate of the party, no one campaigned for him more than Elrufai

Foolish Makinde allowed Wike to lead them into rubbishing the PDP simply because he didn't win a primary election. Today, he's reaping the fruit of his own labour
