Appeal Court Dismisses David Mark’s Appeal In ADC Leadership Dispute by press9jatv(op): 4:28pm On Mar 14

According to the appellate court, it could not review an issue that had not first been decided by the lower court. The judge further held that Mark’s claim that Justice Nwite refused the ex parte application was not borne out by the ruling read in open court.

Justice Onyemenam also faulted Mark for relying on the enrolled order prepared by the court’s registrar rather than the judge’s ruling, stressing that the authentic record of a court’s decision is the one pronounced by the judge.

The court further held that the appeal was invalid because it was filed without obtaining the required leave of court, noting that the order directing parties to be put on notice was merely an interlocutory exercise of the trial judge’s discretionary powers in managing proceedings.

She explained that such an order could only be appealed against with the leave of either the trial court or the Court of Appeal.

The appellate court consequently dismissed the appeal as lacking merit and awarded costs of N2 million against Mark.

The court also ordered an accelerated hearing of the substantive suit pending before the Federal High Court. It directed all parties to maintain the status quo pending the determination of the case.

In the substantive suit, Gombe is asking the court, among other reliefs, to void the emergence of the Mark-led leadership of the ADC.

The other members of the panel, Justices Mohammed Mustapha and Okon Abang, concurred with the lead judgment.

Direct this energy toward explaining to Nigerians why Tinubu deserves a second term and why Nigerians should vote for him after he has failed so woefully, especially in providing constant electricity, which he himself promised to deliver. He even said that if he failed to provide constant electricity, Nigerians should not vote for him when he seeks re-election

What is actually going on in Nigeria political space?.
Why is the failed APC government doing everything to scuttle democracy in Nigeria?.
Yesterday it was LP, because PETER OBI was in the party, since OBI left LP no more crises, no more court cases, no more Inec hanky panky over the party.
Now PETER OBI has joined ADC flimsy court cases here and there.
I don't understand how an individual not a part of the party leadership can suddenly declare himself or be declared by some charlatans and yet recognized by court and Inec as a chairman of the party.

Save Nigeria's democracy is now a Clarion call

Advise them to do the right thing from the beginning. APC that they are trying to copy didn't start like this. ADC is not serious. No authentic membership register. No ward, local government and state congresses. No national convention. Every position is interim. The law doesn't recognize this in choosing electable leaders. Rather than sit down and put their house in order they are busy criticizing every action of the government without providing alternatives. They don't even have the spread. How many of their offices have you seen? If PDP can resolve their leadership problems they are better prepared than the coalition of confusion. After the election they will start shouting rigging. How can you pass exam without adequate preparation? Only noise everywhere.

Politics is about interest, David Mark and other leaders within the party are showing Nigerian that they can't really unite different interest groups.

For me I don't see why this case should be in court. Call the aggrieved parties, sit together and iron things out. Sometimes concessions have to be made, which is part of politics.
