In present day and age even in the western world without photographic evidence or DNA signatures that crime at best would be classified as circumstantial evidence which would allow a man that actually kill someone to be sentenced to life in prison instead of of getting the death penalty in the USA.

The case being a civil one, the threshold drops further down to outright dismissal.
