That is not how insurance works. You don't denial a claim except is negligence. Parking beside a water scaffolding is not negligence. The structure would not have collapsed if it was erected well. Full coverage will pay for the car and go after the landlord to recoup their money.

This can be very tricky because if he knows the water tank is defective and he still go ahead and pack his car beside it , then it can be said to be negligent on the part of the tenant to pack your car beside a water tank you clearly know is defective and can fall


And to prove that the fall was due to defective and poor maintenance after the fall might not be that easy to prove and tenable by just a layman most especially if the water tank has been standing intact for awhile or years

When people pay ground rent to government, shouldn't part of the resources be used in engaging Inspectors to go round properties from time to time to ensure they are safe and compliant with normal building codes. It will save lives.

Yes. He can sue and win. You may ask lawyers. Assuming there are conspicuous warnings placed there by the landlord, warnings of dangers posed by that overhead tank, he may likely not win.

It is good landlords include warnings like this in tenancy agreements being signed by tenants.
