COMRADES, ADC suppose to come out victorious, because the supreme court says that political party affairs lies in the constitution of the party

If the Supreme Court follow similar ruling as the appeal court, we will abandon ADC and go to PRP. This is the wisdom of going straight to the Supreme Court. It gives finality so we know early enough.

Tinubu must go!
seunmsg:
fergie001, you once told me you are not aware of David Mark's appeal to the Supreme court. Well, here you have it. So, why is David Mark appealing to the Supreme Court and asking for a stay of execution when you all claimed the appeal court gave no order against his leadership?

Anyway, the Supreme court will definitely give a similar ruling as the Appeal court as there is really nothing to appeal against. David Mark should go and explain himself to justice Nwite of the FHC and stop the frivolous appeals and propaganda against INEC chairman.

WHAT THE ARTICLE REVEALS — AND WHAT IT MEANS

DAVID MARK'S LEGAL POSITION IS WEAKER THAN HIS TEAM IS PRESENTING IT

The core move here is a stay of execution application, not a substantive appeal victory. Mark isn't at the Supreme Court to win on the merits yet — he's trying to freeze the situation before Gombe's side consolidates the gains from the March 12 Court of Appeal judgment. That's a defensive posture, not a confident one. When your first move at the apex court is "please stop things from moving," it tells you the lower court losses have been real and damaging.

INEC'S APRIL 1 ACTION IS THE TURNING POINT EVERYONE IS DANCING AROUND

INEC removing Mark and Aregbesola from its portal on April 1 is the single most consequential development buried in this report. INEC doesn't act without legal cover. That removal signals the commission read the Court of Appeal judgment as clear enough to act on — and that's a significant institutional judgment call. Mark's lawyers framing Gombe's letters to INEC as "attempted enforcement" is legally clever but practically thin. INEC acted on its own reading of a court judgment, not merely because Gombe wrote a letter.

THE FHC/SUPREME COURT TIMING COLLISION IS DELIBERATE STRATEGY

Mark's team clearly filed at the Supreme Court knowing the April 14 date was already fixed at the Federal High Court before Justice Nwite. The expectation — as NAN correctly notes — is that Nwite will step down or adjourn in deference to the apex court. This is forum management designed to buy time. If the Supreme Court grants the stay, everything freezes. If it doesn't, Mark is exposed on two fronts simultaneously.

THE NAMING OF RESPONDENTS TELLS A STORY

Mark named Aregbesola, INEC, Gombe, ADC, and Nwosu. Nwosu's inclusion is significant — he's the former chairman who stepped aside for Mark. His presence as a respondent hints at the possibility that Mark's team is nervous about internal realignment, that Nwosu could potentially be leveraged by the Gombe faction as a legitimacy anchor for an alternative leadership structure.

BOTTOM LINE DEDUCTION

Mark is fighting a rearguard legal battle with diminishing institutional support. INEC has effectively signaled which way the wind is blowing. The Supreme Court stay application is his last realistic chance to freeze the clock before the Gombe-led faction firms up practical control of the party machinery ahead of 2027. If the stay is denied on Tuesday, the ADC crisis effectively resolves — against Mark.

They said the appeal court did not suspend them from office, that it is Bola Tinubu who is using INEC to oppress them, but they went to the Supreme Court to vacate the appeal court order for their temporary suspension from office.

Wike Boasts Of Helping APC Use Judiciary To Kill Osun LG Funds Case, Warns Party Leaders Against Ingratitude

Minister of the Federal Capital Territory (FCT), Nyesom Wike, has openly boasted that he assisted certain elements within the ruling All Progressives Congress (APC) in deploying the judiciary to frustrate the Osun State local government allocation lawsuit.

In a video now circulating widely on social media and obtained by SaharaReporters, Wike made the claim while addressing a crowd in Port Harcourt, Rivers State.

The former Rivers governor accused the APC National Secretary, Senator Ajibola Basiru, of benefitting from judicial actions against the Osun State Government without knowing those who did the work behind the scenes.

The suit in question led to the withholding of local government funds in Osun State, a development widely seen as targeting the administration of Governor Ademola Adeleke as opposition in the state.

Wike, who spoke angrily, suggested that the court action supporting the APC’s position against the Osun government did not happen by chance, boasting that powerful political forces worked quietly to ensure the outcome.

“Don’t take our support for Mr President for granted,” Wike warned, in an apparent message to APC leaders defending Rivers State Governor Siminalayi Fubara. “You have to be careful about the statements you make. You have to be very careful.”

He accused Basiru of political ingratitude, claiming the APC was enjoying in Osun State without understanding who engineered their advantage.

“Today, you are enjoying in Osun. You don’t know those who did the work,” Wike said. “You are opening your mouth to talk about Rivers State.”

You don't have to lie to drive home your point. Why not drop the specific section that gives the exception of failure to follow party's constitution. The Supreme Court of Nigeria has consistently ruled that courts lack jurisdiction over the internal affairs of political parties, including leadership disputes and candidate selection, deeming them non-justiciable.
So, meaning they can use cutlass and matchet to settle their matter since court are meant to be watching them fight.

At least, you’ve all accepted the truth that the court of Appeal gave the order and INEC as a law abiding commission simply obeyed the order. That’s a good place to start.

You lack comprehension. The appeal court gave several orders including going back to the FHC which the ADC knows was designed to waste time only so that INEC deadlines will be missed.

We're shorting the process by going to Supreme Court so that we can activate plan B in time should they give outrageous judgment
cheesy Omoooo! Like play like play you guys have shaparly adopted the likes of David Mark, Atiku, El-Rufai, Dino Melaye has the new Messiahs just because of the hatred y'all have for Tinubu and you want him booted out?

If they respect their followers, they will not be lying to them openly and brazenly.

WeKeep dreaming, the Supreme have already ruled that the court don't have jurisdiction over internal party matters. Those FHC that have been manipulated to give judgement would be set aside
Why do you people like twisting things anyhow? The idea that courts don’t have jurisdiction over internal party matters is often misunderstood. The general rule is that courts avoid interfering in the internal affairs of political parties, especially on issues like candidate selection or party discipline. However, once a party’s actions violate its own constitution, statutory provisions, or the Nigerian Constitution, the matter stops being purely internal. At that point, the courts can step in—not to run the party’s affairs, but to ensure compliance with the law and due process.

lol. The 2025 electoral act is not applicable to the case as it was filed before the law was passed. The court has jurisdiction to hear the case if it has to do with ADC not following its own constitution.
Should we also say that companies should pay their 2025 tax based on the old tax laws since the new tax law started in 2026? You are wrong, once a law is passed, it takes effect immediately otherwise, we have cases in court that are over 5 years old.

Apart from that, the Supreme Court rules on interference with political parties issues was also based on the old electoral act notbeven the new.

These guys are just wasting time and resources . Supreme Court will still send them back to the high Court. And Gombe might win later and by extension any congress by David mark will be null and void . They are just empowering Tinubu and co to play with them before and after elections.

So logically, with two warring factions claiming rights, what should be the position of INEC and which faction to recognize?

This is logical reasoning!

A party does not have her art together but you blaming INEC and the judiciary for party woes!

You seemed enlightened. What would have been your stance as the INEC chairman?

Waste of precious judicial time. Interlocutory appeals almost always have to await the determination of the substantive matter especially where the res is not endangered as in this instance. The Court of Appeal position followed by INEC is aimed at preserving the res.
