'Membership timeline': INEC appeals judgement, seeks stay of execution by blamingthedevil(op): 6:27pm On May 25
The Independent National Electoral Commission (INEC) has asked the Abuja Division of the Court of Appeal to set aside the judgement of the Federal High Court, Abuja, which nullified part of the the election guidelines put in place by the commission for the conduct of the 2027 general election.

Rexall that last week, Justice Muhammed Umar of the Federal High Court sitting in Abuja, nullified guidelines issued by the INEC directing political parties to submit their membership registers and databases by May 10, 2026, as a condition for participation in the 2027 general election.

A political party, the Youth Party, had filed a suit challenging the legality of the electoral body’s directive or guidelines.

The court said in its judgement that INEC could not lawfully shorten the timeline already provided under Section 29(1) of the Electoral Act 2026 for the submission of party membership records and candidates’ particulars.

But, in the appeal notice dated May 25, 2026, filed by INEC, through its Counsel, Chief Alex Izinyon, SAN, the electoral umpire prayed the court to set aside the judgement of the lower court.

Apart from praying the court to set aside the judgement, the Senior Lawyer, in the appeal, asked the court to stay the execution of the judgement.

This is obviously the Tinubu and the APC appealing the judgment through the Amupitan-led INEC simply to buy time, so that those dissatisfied with the APC’s baba sope political patronage machine and fraudulent primaries will not decamp for now.

Ordinarily, INEC is not even supposed to appeal this judgment. The judge simply held that INEC cannot lawfully shorten the timeline already provided under Section 29(1) of the Electoral Act 2026 for the submission of party membership records and candidates’ particulars.

As expected, the appeal will most likely be dismissed for lacking merit.

INEC cannot issue guidelines that conflict with the very Electoral Act from which it derives its powers.

On what premise is inec appealing the judgement?
Secondly ,what is inec interest in this election other than announcing the results and conducting the elections
And finally what business does inec have to change the electoral laws and being partisan to give advantage to the party in power ?

This is a serious breach and it's a treasonable offence,the inec chairman should be jailed and this man parading himself as san should be derope and jailed too

No court can rule against an act of Parliament.
Infact in this case, the Court is ruling in favour of the Parliament.
The Electoral Act is a product of the Parliament whilst INEC guidelines is for administrative convenience. So, you are supporting the judgement as well.

The Court has ruled many times that where there is a conflict between the Principal Act (Electoral Act) and a delegated legislation (INEC guidelines), the Principal Act prevails and the guidelines is null and void to the extent of its inconsistency.

This is what happened in Nyesom Wike vs Dakuku Peterside 2015.
Then the smart card reader was in INEC guidelines whilst writing of names was in Electoral Act 2010. The Court held that INEC guidelines must bow to the Electoral Act been a Principal Act of the Parliament, that was how people like Buhari, Umahi and Wike won at the Supreme Court.

Infact, the INEC guidelines must derive its origin from the Electoral Act and the CFRN.

INEC never acted on its own. There is separation of power and the judiciary cannot upturn a law dully passed and signed.

The Appeal court will upturn the judgement of the Federal High court.
