The Court of Appeal don set aside part of a previous judgment wey recognise the Peoples Democratic Party (PDP) Caretaker Committee, saying the matter no be issue wey dey before the court in the first place.

According to statement wey National Publicity Secretary of the Interim National Working Committee of PDP, Comrade Ini Ememobong, release on Tuesday, party lawyers confirm say the Appeal Court rule say no live issue remain for the appeal because the main matter concern national convention wey the Supreme Court don already nullify.

The court reportedly explain say the lower court no suppose recognise the Caretaker Committee because that issue no form part of the case before am.

The Appeal Court further note say the proper thing for such situation for be retrial. However, since the main issue don become academic after the Supreme Court judgment, ordering retrial no go serve any useful purpose.

The court also uphold the suspension of A.K. Ajibade and, by extension, other affected officials including Sam Anyanwu.

According to the judgment, Ajibade no get legal authority to act on behalf of the party during the period under review.

The PDP Interim National Working Committee say the latest Appeal Court decision effectively nullify the earlier judgment of the Federal High Court in Ibadan, wey the Independent National Electoral Commission (INEC) use as basis to recognise the Caretaker Committee.

Following the ruling, the party urged INEC to immediately withdraw recognition from the Caretaker Committee and instead recognise the duly constituted Interim National Working Committee led by Kabiru Tanimu Turaki (SAN).

The development marks another chapter in the leadership crisis rocking the opposition party as different factions continue to battle for control ahead of future political activities and elections.
