My house rent expires in December 2025.The landlord agreed that he will repair the house before another rent payment but he refused and he insisted that the rent must be paid.Meanwhile,he said same thing last year but he refused.He brought a quit notice on May 9 indicating that we should vacate the house on May 31, please what's the position of the law on this.

u have stayed in d house free for close to 6 months so that's enough quote notice space

Pay him or leave but don't think d law will give u another 6 months free

You are entitled to 6 months' notice before a tenancy can be terminated. The 3-week notice your landlord gave you is far too short and is legally invalid.

Also, a landlord cannot issue a valid quit notice simply because a tenant demands necessary repairs. The requirement for a 6-month notice is absolute, and his failure to follow this procedure renders the notice you received effectively worthless.
Even though the quit notice expires, the landlord can not evict you. Only the courts can evict you.

If he brings police to your house, keep repeating that this is a civil case. Don't reply to any policeman's questions.

Let's see if he will take you to court. Only reply to the court not a policeman.

Only the courts can evict you.

Changing locks, removing your belongings, or cutting off utilities without a court order is illegal and you can sue for damages.

He has an option, to reduce house rent which he is not willing to do. So relax yourself.

Lastly don't sign anything.

It's not that I don't want to pay but he's fond of collecting without repairs.Infact, we were in that house for a year before he fixed water.
He liased with our neighbour and we fetch water only once in a week.

Though I'm on the lookout for another apartment but I don't want to make same mistake as his.

It is very ok you tell the landlord to repair the house to justify the rent you are paying but everything is wrong if you refuse to pay your rent because of that. You should've simply find another house and move out. You don't have power to force him to repair his house, when he did not force you to remain there.

As for the quit notice, he can actually evict you with few weeks notice if what he stated in that quit notice is about your refusal to pay rent.

6 months quit notice is not applicable if tenant refuse to pay his/her rent. If tenant had paid in part, lost his source of income or offer to pay half payment, the law can still reason with him. But in this case, he blatantly refuse to pay and keep using the facility. He is only within his right to demand repair of the house that is affecting him when he is still within his renting period. During the period,he has the right to sue the landlord for immediate repair, demand for returning rent and move or force him to pay for the demage.

tenancy law in Lagos state guides the process like this

A tenant dt is paying is rent every 3mnt is given a period of 3mnts to stay after his/her rent expires wen issued a quit notice.

A tenant paying rent every 6mnts is also given a period of 6mnts to stay after his rent expires before he /she leaves the apartment..

Similarly, a tenant paying is rent annually is also given 1yr to stay after his/her rent expires before leaving.

But most of these landlords dnt follow such instruction.

Most of dem use dt excuse of renovation to evict tenants weda you are paying ur rent regularly or not. They Increase the rent,put anoda tenant. collect new agent and agreement fee.

wat I will advice is dt dnt argue or challenge ur landlord base on this law and at the same time dnt talk with fear.

Be calm and make your point known to him.. be diplomatic in reaching a reasonable agreement wit him Most of dem play on tenants lack of knowledge of the process to force you out.
The way they evict tenant A dt doesn't understand the process is not the same way they evict tenant B dt understand how it is done

Also note dt it is the court dt can arbitrate btw you and him.
