As it is now only 3 parties - the APC, PDP and LP have met the constitutional requirement of 25% of votes cast in a presidential primary. But this requirement was not in the electoral act before otherwise the APC and LP would never have been registered as political parties.
So the question is, when was this provision snuck in? And what have the legal advisers of the now deregistered parties been doing? This is malpractice!

This would certainly go all the way to the Supreme Court but the time is too short to come to a conclusion that may deregister the parties.

Any attempt to deregister the parties NOW would lead to huge conflagration in the polity. It is too late to bring these up now.

Because the electoral act and past supreme court judgements have barred INEC from disqualifying any candidate or deregistering any party because the electoral act did not empower INEC with such powers.

The onus then lies on a court of law to do the needful when approached by a petitioner to do such.

Minister of the Federal Capital Territory (FCT), Nyesom Wike, has openly boasted that he assisted certain elements within the ruling All Progressives Congress (APC) in deploying the judiciary to frustrate the Osun State local government allocation lawsuit.

In a video now circulating widely on social media and obtained by SaharaReporters, Wike made the claim while addressing a crowd in Port Harcourt, Rivers State.

The former Rivers governor accused the APC National Secretary, Senator Ajibola Basiru, of benefitting from judicial actions against the Osun State Government without knowing those who did the work behind the scenes.

The suit in question led to the withholding of local government funds in Osun State, a development widely seen as targeting the administration of Governor Ademola Adeleke as opposition in the state.

Wike, who spoke angrily, suggested that the court action supporting the APC’s position against the Osun government did not happen by chance, boasting that powerful political forces worked quietly to ensure the outcome.

“Don’t take our support for Mr President for granted,” Wike warned, in an apparent message to APC leaders defending Rivers State Governor Siminalayi Fubara. “You have to be careful about the statements you make. You have to be very careful.”

He accused Basiru of political ingratitude, claiming the APC was enjoying in Osun State without understanding who engineered their advantage.

“Today, you are enjoying in Osun. You don’t know those who did the work,” Wike said. “You are opening your mouth to talk about Rivers State.”

But it's the law.

ADC did very poorly in the last Presidential elections by not getting even up to the minimum 25% in any one state and they proved their unpopularity by not even winning any single seat during the bye elections .

The case had been pending since after 2023 elections.

There's even 3 cases in court pending with 3 different parties challenging David Mark emerging as the National leader .

The problems on ground in the ADC too much.

The bolded is wrong..

The condition to remain a recognised political party hinges on performance at the polls.

A freshly registered party like NDC is exempt from this as they are yet to contest any election and their fate will be decided on the basis of how they perform in the next electoral cycle .
