Let me explain this thing properly. The woman you marry might not take care of you in old age because she is also battling old age too.
The solution. Marry a young wife or your child will have to forfeit their dream in other to take care of you while other children support financially.

There's a reason why Abishag the shunamite was chosen to take care of king David when he was old and not his wife.
Because queens weren't brought up to take care of kings in their vulnerable moments.

She should appeal the Judgement. Even within Yoruba culture, she will be recognized because she had a child for him. In Yoruba culture, she is more than a concubine.

The law is superior to the culture, the law will only protect the child if he is less than 18, it has no business with the partner, the protection might ultimately give benefits to the partner through the child, but not to give to her directly.

I think where Helen prest missed it was getting the man to include the children from her previous marriage as his and also allocating property to them as his children in his will. This is what the first wife challenged and said since they were not legally married, Helen prest children from her first marriage had no rights as n the will and it was made under duress to include them.

The courts have ruled that there may be illegitimate marriages but there are no illegitimate children, so if your husband has a child outside your marriage, as long as there is evidence to prove that the child is his, if the man dies and the “outside child” is not included in his will, that “ outside child “ can go to court to render the will invalid . So men take note and wives also take note.

Helen should fight for her child she had with the man to be included in the will, that’s the only thing she is entitled to.

Someone said the first wife knew all these and had a game plan in mind , and that is why she refused to divorce the man. A woman that wants to take revenge on another woman can wait a 100 years and the feeling will not reduce by 1%. A man might ignore after some years, but you see women, na lie ooooooo

The reporting or judge is horrendous.

A man's will once of sound mind cannot be set aside.
The issue could be the properties in Ajayi's will may not be his to give away.
They could be common property of him and his (never divorced) wife.
The judge might finesse property he acquired after declared open notorious seperation

If you had not disowned them with “ reasonable cause “ or divorced them properly in the eyes of the law, they will go to court and the court go give them something from your property.

For example, if your son na the biggest armed robber in town , you can disown him on that basis and the court go back you up( evidence must dey oo) and the guy no go get shishi from your will.

Why do you think the court specificially raised the Kalabari marital angle and stated the she brought it up only as an afterthought. That shows you how naive and ignorant to think culture counts for nothing.

She may get some reprieve on appeal and only culture will give her some window.

There are people in her situation yet fully protected by the culture. I have an idea of the fatal flaw she made but won't tell you wink

Do you see the addendum of the justice on that, he said even if the customary angle was true, it can't still have a stand as there is an existing valid legal marriage.
Customary argument can only be valid if it was done before a legal marriage, that's when the court can consider if the legal marriage was done under deceit

The case has been ongoing for over 5 years since the doctor passed away in 2020. Helen you did yourself dirty, as a lawyer you should know better. The court will always recognise the legally married wife no matter how long they've been separated.
Helen Prest grossly mismanaged her life by living-in with a man to whom she was not married for a record twenty-five years!!! Quite shameful and reprehensible that she turned out a gold-digger when she had no reason to be one having been born into an illustrious family. More worrisome is that the churches the parties apparently were associated with watched Helen Prest and Dr. Tosin Ajayi live in adultery for 25 years!!! On second thoughts the churches may not have known that they were living-in!

Ladies Always make sure that married man that you are loving has divorced his wife if not you will cry tears with nothing to show for it.

I saw a story like this where the lady was taking care of this old man and the real wife never visited for one day. The day the man died the real wife visited, caused trouble and the lady left the house. After burial the wife traveled back abroad the next day.

Helen Prest had a valid claim but failed cuz she could have gotten better lawyers, Mrs Ajayi case was handled by a SAN, Helen Prest should have done same with the magnitude of what was at stake, hiring from the top law firms in Nigeria (Aluko & Oyebode, Banwo & Ighodalo, Olaniwun Ajayi, Templars etc) would have been money well spent for Helen Prest.

Helen Prest had better appeal and bring an atomic bomb to the battle (eg evidence of Mrs Ajayi infidelity, proof the deceased no longer wanted anything to do with her etc grin).

Anyways 3 gbosa to Mr Kunle Adegoke SAN for winning this round. I like good lawyers. Mrs Ajayi was wise enough to hire a SAN, the cunny woman brought a Bazooka to a gun fight grin
1. Mr. Adegoke was not Silk five years ago when the Suit commenced.
2. Not even a Perry Mason, Wole Olanipekun, Johnny Cochran, Solomon Awomolo, Yusuf Ali, Kizor Akaraiwe et al could have won the case for Helen Prest in the absence of a valid bequest in her favour in a valid Will. The daughter Helen Prest had for the deceased misfiring gun certainly has something from the Estate!

I was in the court when this matter came up in 2021 when they were still dragging who had right to the body of the doctor😁

Femi Falana represented Ms Helen who was also her classmate, and another Senior Advocate on the other side. It was a very contentious day in court. We were there till 4pm 😂 but that also was also a stroke of luck for me cos on leaving the court I met one of my most important client till date.

The Court literally prepared the burial rites ie the brochure, the location and what each side should contribute that day. It was a funny thing but I learnt something that day, don’t live your life in such a way that in your death, you’d cause chaos.

At the time the matter came up in court then, he had been in the mortuary for 9-11months, both sides were laying claim to his body.

Anyways Ms Helen has already appealed the judgement, so the drama continues.
Helen Prest is wasting her time and is sure to get some tongue lashing from the Court of Appeal. The facts and the Law on the matter are fairly straightforward!
