Then INEC would have deregister AAC long ago

The recent court ruling against the NDC (Nigeria Democratic Congress, a newly formed political party in Nigeria) is from the Federal High Court in Lokoja.

What the Ruling Is:

On June 26, 2026 (today), Justice Isah Dashen of the Federal High Court in Lokoja set aside (nullified) an earlier judgment from December 10, 2025.

That earlier judgment had compelled the Independent National Electoral Commission (INEC) to register the NDC as a political party.

The court ruled that the prior judgment was constitutionally defective because it was delivered without hearing from the Peace Movement Party (PMP), which claims ownership of the logo used by the NDC.

As a result, the court ordered a return to the status quo ante (the situation before the earlier judgment). This reverses INEC’s recognition, certificate issuance, and any inclusion of the NDC in records or on ballot papers.

The substantive suit will now proceed afresh, with INEC, the Peace Movement Party, and the NDC as parties.

In short, the NDC’s registration as a political party has been cancelled (at least for now), and it is not currently recognized by INEC.

Does It Stand?
Yes, it currently stands as the operative decision. It was delivered today by the same court (Federal High Court, Lokoja division) that issued the original order.

The NDC (and any affected parties) can appeal to a higher court, such as the Court of Appeal, but there is no indication yet of an appeal having been filed or succeeding. The ruling effectively nullifies actions taken under the previous judgment.

Can the High Court Overturn Itself?
Yes, in this context it can and did. Nigerian courts (including the Federal High Court) have inherent jurisdiction to set aside their own judgments in certain circumstances, especially where:

1. There was a fundamental defect (e.g., lack of jurisdiction, failure to join a necessary party whose rights are affected, or breach of fair hearing).

2. The judgment was given without hearing all interested parties (as here with the Peace Movement Party’s logo claim).

This is not a review on the merits but a correction for procedural or jurisdictional issues. Courts distinguish this from simply changing their mind on a fully heard case. The power is exercised judiciously, often for default judgments, ex parte orders, or when new parties/interests emerge.

This explains the silence from the APC since Obi left the coalition. We advised Obi to stay put in the coalition that the stakes are too high and that Tinubu is hell-bent on having no viable opposition in 2027 but he chose to leave for what was obviously a trap. With Obi remaining in the coalition, Tinubu would have been too afraid to destroy a united coalition as it will invariably mean that he has declared himself a dictator.

Meanwhile, Tinubu should keep testing the patience of Nigerians with his undemocratic moves against opposition parties. The patience Nigerians are exercising is only being sustained with the hope that they can make their votes count in 2027.

The court ruled that these parties performed poorly and failed to meet these benchmarks during the 2023 elections and subsequent by-elections.

It is only an Appeal Court can vacate the judgement of a State High Court or Federal High Court.

Even if it is the same Judge (which is actually the case here), it is not possible..

It is only an Appeal Court that can upturn the judgement.

Meanwhile, NDC should file for a stay of execution of the new order (and no “Ante Bellum” clauses should be introduced)
