Muslim Marriage under Islamic Law after Registry Marriage in Nigeria: Legal Clarifications

Summary:
1. Registry marriage under the Marriage Act does not prevent a Muslim man from marrying additional wives under Islamic law.
2. Islamic law is distinct and codified, unlike customary law.
3. The right to marry multiple wives under Islamic law is protected as a fundamental religious right under Section 38 of the Nigerian Constitution.
4. Courts uphold the coexistence of statutory and Islamic marriage laws, ensuring religious freedom and legal pluralism.

Recent landmark rulings by the Nigerian Court of Appeal and Supreme Court have clarified the legal position of Muslim men who marry under the statutory Marriage Act (registry marriage) and subsequently marry additional wives under Islamic law.

In Mohammed and others vs Muhammed and others (2024), the Court of Appeal affirmed that a Muslim man who has married under the Marriage Act is still entitled to marry up to four wives under Islamic law. The registry marriage does not extinguish or limit his right to contract further marriages according to his religion. This ruling underscores the constitutional protection of religious freedom under Section 38 of the 1999 Constitution of Nigeria, which guarantees the right to freely practice one’s religion.

The Alkama vs Bello case further distinguishes Islamic law from customary law. Islamic law is codified and written, whereas customary law is largely unwritten and subject to validity tests. The courts have emphasized that Islamic law is a distinct legal system with its own rules and protections, especially regarding marriage and family matters.

Importantly, the courts have ruled that denying a Muslim man the right to marry up to four wives under Islamic law after a registry marriage constitutes a violation of his fundamental right to religion. This decision reinforces that Islamic marriage laws operate alongside statutory laws without conflict, respecting Nigeria’s plural legal system.

So a Muslim man who married a non-muslim woman can marry more wives now?

Alhamdulillah!
Re: Muslim Marriage Under Islamic Law After Registry Marriage In Nigeria by TV01(m):
Islam doesn't really have marriage as properly defined. Holy matrimony the coming together of 2 as 1.
What it has is a form of lopsided domestic transaction - which favours men and leaves women (and girls) at their mercy.

In fact, "marriage" in Islam is part of, and sits atop a layered domestic arrangement, which includes temporary marriages and s3ks slaves.

Long\short, Islam hates women and sees them as an accoutrement of men, which makes abslute sense if yu are a 7th century Arabian brigand whose main occupation is banditry and pillaging. What is to become of all the females left after you have raided, slaughtered and dispossessed the rightful owners?

I could be wrong though? Perhaps someone could explain why s3ks slaves would be a thing in anything resembling a normal society?

That's holy matrimony as defined by the writer of the book of Matthew!

Yahwh gave David plenty wives and even wanted to add more! I don't think he forgot polygamy was bad/sinful.

I gave your master’s house to you, and your master’s wives into your arms. I gave you all Israel and Judah. And if all this had been too little, I would have given you even more. 2 Samuel 12:8 It is the Bible that hate women starting from the time of Eve! I can give you evidence if you need them!

The rulling does not guaranteed protection of religion, but biases of judges handling religion's litigation.

Any Muslim who wishes to marry more than one wife, he should do Islamic marriage, .....very very simple instruction for religion who is not stubborn to constituted authority, but we are in a country, where a religion must find a way to lord it's interest over every constitution, law, codes and conducts.

Re: Muslim Marriage Under Islamic Law After Registry Marriage In Nigeria by SixSeven: 12:16pm On Oct 02
In the case Mohammed v. Mohammed (2024), the Nigerian Court of Appeal shifted decades of family law when it ruled that a registry marriage does not prevent a Muslim man from marrying up to four wives under Islamic law. Denying this right violates his constitutional freedom of religion. Historically, a civil wedding under the Marriage Act created a strictly monogamous union. Entering a subsequent marriage while that civil union subsisted constituted the offense of bigamy under Section 35 and Section 47 of the Act.

The Court of Appeal utilized the Supreme Court precedent of Alkamawa v. Bello, clarifying that Islamic law is separate and distinct from customary law. The restrictions in the Marriage Act target customary marriages, meaning they do not automatically ban subsequent Islamic marriages (Nikah). The court held that a registry wedding does not mean a Muslim man has renounced his faith. Therefore, preventing him from practicing Islamic polygyny violates his fundamental right to freedom of thought, conscience, and religion under Section 38(1) of the 1999 Nigerian Constitution.

In simple language 👇

If a Muslim man has a court wedding (registry marriage), that marriage is still completely valid. However, the law now says the court wedding cannot be used to stop him from marrying more wives later under Islamic rules. Any subsequent wives married under Islamic law and their children are legally recognized. They have the full legal right to inherit the husband's property when he dies. Because this is a decision from the Court of Appeal, it is currently the binding law across Nigeria. It will remain the law unless the Supreme Court overturns it in a future appeal.

Have u not seen Christians marry more than 1 wife? Even with them doing registry. I have seen Muslim men married to only 1 wife. Even with the 2 shall become 1, almost all the men in the Bible had more than 1 wife. The highest rate of divorce comes from Christians.

What is the difference between a Muslim man that has 4 wives and a so call Christian that has 1 wife and 4 side chick even after registry.

Hypocrites. Do Christianity of sure protect women. Regardless of religion, a good man will always be a good man, a man who respects and treats a woman right doesn't have anything to do with religion.

Instead of drooling over how many wives you can marry in Islam, I expected to see rulings on hijacking planes with the intention to commit suicide and kill other innocent souls along with yourself.
What does Islam say about killing Jews by hijacking planes? Is it permitted? Will the murderer be welcomed in AlJannah to a suite filled with the customary famed 72 virgins or will he be sent to hell for being a murderer?
This is the hot topic about Islam today. How do we deal with and put an end to Islamic terrorism? I suggest the idea of 72 virgins be totally expunged from Islam. Sex is a major driver for Islamic terrorism

Yes, women were made for men, after men and from men. Never the less, man comes from women. Purpose, order symmetry, beauty, Christianity. All I can see from the ee.slam.ic text is that women were made to satisfy man's carnal urges, no?

Yes for modesty and the angels sake

Yes, the creational order and family hierarchy mean men should lead homes and church affairs

Yes, modesty for all is instructed and as above. Christian women are equal partners with different roles. A 1:1 relationship. Not like the ee.slam.ic fractional affair lipsrsealed, with concubinage and sks slafe decimal on top shocked

Yes, the head of a wife is her husband. Men lead and have the main responsibility to God for their family. It makes no sense for a woman to be wayward if her husband is disobedient. God can and will deal with the erring husband of a faithful Christian wife.

AntiChristian:
And one more question, can a Christian woman divorce the husband if he abuses her according to Jesus's rule on divorce?
I do not see divorce in Christianity. An abused spouse can separate. If reconciliation cannot be effected, they remain as they are. Remarriage is permitted upon death of a spouse.

It's not the transactional, lopsided and discriminatory transaction that characterises ee.slam.ic unions. "marriage" in ee.slam, is an excuse for carnal relations, whereas, physical intimacy is a key underpinning of the marital union. ee.slam, get's everything wrong and everything back to front.

I asked you one question, you replied with 100's of queries and no answer. I'll try again. "Please explain how seks slafery works in a normal society". Any society sef huh
