WHAT IS STEALING?
Criminal Code Act, Chapter 77, Laws of the Federation
of Nigeria 1990

Chapter 34

Stealing


383. (1) A person who fraudulently takes anything
capable of being stolen, or fraudulently converts to his
own use or to the use of any other person anything
capable of being stolen, is said to steal that thing.

(6) A person shall not be deemed to take a thing unless
he moves the thing or causes it to move.

390. Any person who steals anything capable of being
stolen is guilty of a felony, and is liable, if no other
punishment is provided, to imprisonment for three
years.

Corruption and Abuse of Office


98. (1) Any public official (as defined in section 98D)
who-

(a) corruptly asks for, receives or obtains any property
or benefit of any kind for himself or any other person;
or bribes, etc.,

(b) corruptly agrees or attempts to receive or obtain
any property or benefit of any kind for himself or any
other person, on account of-

(i) anything already, done or omitted, or any favour or
disfavour already shown to any person, by himself in
the discharge of his official duties or in relation to any
matter connected with the functions, affairs or
business of a Government department, public body or
other organisation or institution in which he is serving
as a public official, or

(ii) anything to be afterwards done or omitted, or any
favour or disfavour to be afterwards shown to any
person, by himself in the discharge of his official duties
or in relation to any such matter as aforesaid, is guilty
of the felony of official corruption and is liable to
imprisonment for seven years

98A. (1) Any person who- Official corruption: person
giving bribes, etc., on account of actions of public
Official.

(a) corruptly gives, confers or procures any property or
benefit of any kind to, on or for a public official (as
defined in section 98D) or to, on or for any other
person; or 1966 No. 84.

(b) corruptly promises or offers to give or confer or to
procure or attempt to procure any property or benefit
of any kind to, on or for a public official or to, on or ’ÃO any other person,

98B. (1) Any person who--
(a) corruptly asks for, receives or obtains 'any property
or benefit of any kind for himself or any other person;
or

(b) corruptly agrees or attempts to receive or obtain
any property or benefit of any kind for himself or any
other person, on account of-............................is guilty of
the felony of official corruption and is liable to
imprisonment for seven years.

All the educated illiterates from APC that litter this forum insulting my capable president when he said stealing is not corruption should hide their face in shame and if they have any dignity left they should tender their unreserved apology to this man and carry on with their lives

The constution is clear on this stealing is not corruption but worse than corruption.And by the doctrine of judical precedence stealing is not corruption because justice mustspha whom jonathan quoted has ruled that stealing is not corruption

Stealing and corruption are punishable under the our constitution so close to six years that he have been the president, what has he done about stealing talk less of corruption? Is he a judge? Jonathan desecrate the office of the president by differentiating two wrongs. Is that the reason he was elected? We are definitely sending him back Otuoke

It's a really big shame how some PDP supporters stoop so low to defend the indefensible clueless Jonathan. This "stealing is not corruption" issue is something that is supposed to be understood by a 4-year old yet some grown-ups come here to spew rubbish.

Jonathan in his speech that day said the following:
Speaking about corruption, he stressed that a country where everyone talks about corruption cannot work together to change the perception. He differentiated corruption from stealing, adding that Nigerians mixed them up.

He said that most of the cases where corruption issue is being raised are COMMON STEALING . He added that corruption is being overused.

What did Jonathan mean by "Common Stealing"?? What is being stolen? Who is stealing? Those are questions sane people should be asking. Therefore if Jonathan asserted that the cases in his government were "mere stealing" not corruption, it is safe to say that he meant that Public Officers were "stealing money" but were not indulging in "corruption"? Right?

This is a simple question that a four year old (who hasn't sold her brains to PDP) can answer....What do you term the stealing of funds by a Public Officer?? It's CORRUPTION!!

This is a point many of them refuse to understand. We know the ordinary meaning of corruption, but in the criminal code it focuses on 'public officials'. So the argument as to whether Stella Oduah etc were involved in stealing or corruption is hardly one that is likely to amuse the public, especially when there seems to be no repercussions for either stealing or corruption under Jonathan. Neither is a commendable thing.

As a logical analyst he only differentiated them so their meanings become clearer, he never justified any. What's the problem there?

The good thing about all this is that ordinary Nigerians - the real Nigerians out there on the street who don't have time to waste on the internet - are tired of these lectures on the difference between corruption and stealing. These Nigerians - the 'real' Nigerians - are not happy. They wanted action, not English lessons. But your principal didn't deliver.

No one can say how the events of the next few weeks will play out. But it isn't looking good for your principal at all. He had a golden chance to write his name in the history books and he threw it away.

If these thieving politicians are tried as thieves not corrupt people there will be no plea bargain or elongated court cases..

After Nigerians would be shouting that a boy that stole some Yam was sentenced to 3 years whereas the politician that stole millions is branded corrupt and allowed a plea bargain and 3 months house arrest

Nigerians want action, not speeches. There is no need for me to give examples where your principal failed to enforce the law. They are legion. The only thing left is for Nigerians to show their displeasure with this failure to deliver. We shall see in a few weeks time, if all goes well.

This lengthy debate on the difference between corruption and stealing is a brazen diversion from the key issues that could only be possible in a place like Nigeria. Your principal cannot successfully prosecute economic saboteurs(remember the fuel 'subsidy'?) but he gives regular lectures on syntax, lexis and structure as well as antonyms and synonyms for the words 'corruption' and 'stealing'. undecided. And you are brazen enough to try to sell this farce as some kind of rare insight or a Nigerian version of deft statesmanship. undecided

That is still stealing. Taking what doesn't belong to you illegally.

You are right but the issue here is that the process of convicting a corrupt person is much more difficult than to convict a thief.
GEJ is saying if you have evidence that these politicians stole money charge them to court as thieves not beautifying them as corrupt to complicate the court process.
Corruption as the criminal code define is a systematic issue and to gather enough exhibit to proof beyond all reasonable fact is so technical that is why brilliant lawyers exploit the complicity to walk out with their clients.

To charge them as a thief is an individual issue which can relatively be easier to prove
