A Federal High Court in Lagos has barred the Nigerian Electricity Regulatory Commission from giving effect to its proposed increment in electricity tariff.

Justice Mohammed Idris made the order on Thursday after a Lagos-based lawyer, Mr. Toluwani Adebiyi, moved an ex parte application to that effect.

The Chairman of NERC, Dr. Sam Amadi, had, at a recent press conference in Abuja, disclosed the plan by the commission to implement an upward review of electricity tariff payable by Nigerians.

The proposed increment, Amadi said, was billed to commence from June 1,2015.

But Adebiyi, who claimed that the proposed increment would “foist further hardship on Nigerians,” had appeared in court on Thursday with a motion ex parte, praying the court to stop it.

Amadi, while canvassing argument before the court, contended that any increment in tarrif was unjustifiable in the face of poor or erratic supply of electricity by the distributing companies.

According to the lawyer, if the proposed increment is allowed, most electricity companies will retain the N750 fixed charge.

Justice Idris, after hearing the application, ordered that the status quo be maintained pending the determination of the substantive suit.

The judge ordered the plaintiff to serve the motion on notice and other processes in the suit on the NERC.

Justice Idris also granted leave to the applicant to serve the originating summons, the affidavit in support, list of exhibits and the written address on the defendant in Abuja, which is outside Lagos judicial division of the Federal High Court.

The judge also adjourned the suit to June 11, 2015 for hearing.

In the main suit, the plaintiff is seeking an order restraining the NERC from implementing any upward review of electricity tariff without a meaningful and significant improvement in power supply at least for 18 hours in a day in most communities in Nigerian.
All they know is to increase and not to offer value. Bunch of thiefs. I feel like strangling someone right now.

Re: Court Stops Proposed Tariff Hike By Electricity Firms by Nobody: 4:45pm On May 28, 2015
This doesnt call for joy. It is just an exparte application. The substantive matter is yet to be heard and I can't see how he is going to win the substantive suit. Besides they would most likely ignore the court order and nothing would happen. Contempt proceedings don't usually work in Nigeria.

One area public corporations in Nigeria are so dumb is just this pattern....

Need to balance the sheet, then GET IT FROM THE MASSES!!!

It a dumb, very dumb idea and no one seem to want to halt it save a few lawyers that really have the masses at heart.

The "sebi it is because of them, eehhh, let us get it from the streets now" mentality. Once again, these public office holders, etc are lucky serial killers arent trailing them professionally. But that's fantasy.

Really dumb. To keep collecting from the masses and never give lasting stuff back shows dumbness

i wonder what stops the lagos state government from building modular power plants and selling the output directly to eko and ikeja disco. i can vividly remember when Sam Amadi, chairman of NERC said unequivocally that they have signed to acts into NERC code. those two acts provides the opportunity for distribution companies to seek out modular power plant from companies involved in generating power in smaller quantities.

I wish Buhari will have the balls to bring those scammers at our various DISCOS to justice.... or atleast force them to provide electric subscribers with electric meters. Imaging MTN, GLO, AIRTEL, ETISALAT etc giving us estimated bills?

How can power improve when our DISCOS make huge returns every month with little power supplied to consumers via ESTIMATED BILLING SCAM?
Arm every power subscriber with a working meter and see the dubious revenue of our DISCOS drop to an all time low. This scenario would force them to seek increase production and distribution of power to maximize profit and not the arbitrary increase in subscription fees as reeled out by that madman called Amadi, whose village is not far from mine.

really i wish it stops too. No one at the top seems to have the guts, if i may use that word, to make this trend of over 3decades to stop. More like a compulsory thing that must happen till kingdom comes.

I used to have this mentality that any new government that cant tackle the power sector will NEVER DO WELL in other sectors, save the Oil sector of course(sacarsm intended).
