Do we have any chance of getting our money back out of court? In 2009 we fixed 400k with one of the new generation banks through a marketer(names witheld for now), for 5yrs which matured in march 2014. The transaction was done in ilesa bt we opened another account in osogbo where we live to receive our interest which we received quarterly but towards the end of 2013 the interest stopped coming we didn't mind thinking maybe its because we are receiving our capital in march of the succeeding year alas! the time came we visited the bank in April 2014 they told us to go and get the statement of account through which we received interest which we provided then they told us that the marketer has been laid off that we should go and look for him because he is the one that can shed more light on the state of the transaction. I was furious i wanted to fight the staff telling me that rubbish after providing all evidence of payment and transaction thanks to my sister who calm me down. We searched for the marketer bt we didn't get him. I told my siblings that they should stop looking for the guy afterall he diid the transaction on behalf of the bank which they didn't deny, i consulted my lawyer who wrote the bank in june this year a week later the bank responded asking us to give them three wks to conduct investigation on the issue and get back to us. My lawyer says we have a good case in case the bank refuse to cooperate but my fear is if we go to court it might take several weeks/mnths and we need the money ASAP. Is there anyway we can get our money out of court if the bank don't give us a favorable reply this week?. |

you will get your money back including extra when you file damages. the problem is that it will not be as fast as u need it |

The steps your lawyer is taking is the right step in the right direction. The bank should be held responsible for any act committed by their staff. The bank wouldn't want to let this go further because it will ridicule the image of the bank to the public. If it goes to the law court, you can claim damages of which I know the bank wouldn't want to go through that. In fact it was an unprofessional attitude for the bank to tell you to go look for the customer. You have a very good case because they employed the staff and under them that the transaction was established and thank God you have documents to back up this.I knew of a case whereby a lady bought shares from a bank and the lady staff did not give her any receipt for the purchase of the shares.Later when she got to the bank, she was told that the staff had left the bank and they requested for any receipt but none.She lost her case. Anytime you are doing any transaction with any bank these days, keep track of all transactions with you.Most bank staff these days are mare fraudsters.I do not blame them but the bank itself for employing them as contract staffs and can throw them out as they want hence they find means to defraud their employers. I think The Nigerian Institute of banks and also The CBN should put a stop to this by asking banks to stop contract staffs as they have done more harm to the industry than good. |

@andyanders, kudos bro, i almost slap the idiot staff can you imagine them teeling us to start looking for a laid off staff as per the case we know we have a good case but you know nigeria court now cases take long time to conclude and we want the cash soonest anyway thanks for ur contribution |

Erukulele:Let your lawyer get back to them and make the see the need to get the issue resolved on time so that you can get the issue sorted out.Make sure that you have a good lawyer, not the one that can go behind you and collect money and keep dragging the case until frustration sets in. If I were to be you, I will be shouting on top of my voice in the banking hall and also go to their head office and tell them that I will call in the press or go to AIT on this issue.The bank wouldn't want to hear this and they will pay you off. |

andyanders:the barrister is good well known in osogbo and its environs by my calculation i think he is scheming for court case to make more money while we don't want delay btw u be pastor cos it be like say u dey read my mind based on creating a scene in the banking hall. I give them till monday reply or no reply mehn we re storming the bank no activity until they resolve the issue. I know say i get lil stubborness and am outspoken am ready to engage anyone even their branch manager. |
