The News Agency of Nigeria reports that Omoyele was on Monday brought before Olagbegi-Adelabu on a charge of stealing 25 aluminium roofing sheets belonging to Ajiga.

The Magistrate, Mrs Jumoke Olagbegi-Adelabu rules that Since Ajiga has shown remorse, caution and did not waste this court’s time by pleading guilty, I hereby discharge him and strike out the case

Nigerians don't read to comprehend! it's clearly stated that the dead guy was a CRIMINAL! the accused acted spontaneously and the criminal ended up dead....know the judge has decided to let the accused go free because of his attitude of remorse and guilt plea.....I don't see what is wrong in what the judge has done.

I am not a lawyer...but that is a case for manslaughter really....not a case of murder...or even for discharge and acquittal.

Unless he could prove that he acted in self defence.

What is reasonable about killing your fellow man over aluminium sheets? why not charge him to court? you cant just set a killer loose coz he supposedly showed remorse for a heinous crime.

The person above me: you need to read it again. There was a murder!

However I don't believe this story. Magistrate court don't even have the jurisdiction to try murder.

Secondly assuming the case was in the appropriate court the judge would have no such discretion to discharge a murder suspect based on remorse.

Well, it's a tricky situation. If the original thief wasn't in any way a threat to the convict i.e. didn't threaten the convict with any weapon, I don't see why the convict should lynch him.
At the minimum, I expected the judge to sentence the convict to some months in prison in order to discourage jungle justice.

I still do not find murder in this case. Ajiga assaulted Raheem Omoyele for stealing his{Ajiga's} roofing sheets. Ajiga charged to court on assault{taking laws into his hands by lynching Omoyele} On the other hand, Omoyele was also charged to court for stealing. So, where is the murder? Perhaps, Vanguard omitted that part of the story or there's mix-up somewhere.

I'm at a loss as to how the guy was charged with murder in the first place, if the bolded is true... some people didn't do their job well before reporting this news

Regardless of the criminal-victim's crime , the accused has no right to mete out punishment or even kill him.
The judge should at least have sentenced him for manslaughter.
This emotional judge just freed a murderer and I hope police appeal the case.
Note that this is not different from the Aluu 4 case.
