I ask this question because the 8th Senate led by Abubakar Bukola Saraki and majority of her members' have decided to equate Saraki's legal troubles to that of the Senate. Just two days ago, the Senate decided to postpone planery for a day to enable them allow Saraki not to miss out on any ministerial screening due to his ongoing trial before the code of conduct tribunal. Senate's Action Violates Section 53(1)(a) of The Constitution: Section 53(1)(a) of the Nigeria constitution clearly defines who should preside over the affairs of the Senate in the absence of the President. It defines thus... (a) in the case of the Senate, the President of the Senate shall preside, and in his absence the Deputy President shall preside; The Senators that are supposed to be the very people to uphold the law went ahead to disregard constitutional provision by electing to postpone sitting/planery in order to accomodate the trial of Saraki in its legislative calendar instead of allowing the Deputy Senate President to perform his constitutional mandate in the absence of the Senate President. The Senators Violated Their Code of Conduct as Public Officers: Part one of the fifth schedule of the constitution that deals with the code of conduct for public officers listed some of their Dos and Don'ts. Paragraph one of the code states that... "1. A public officer shall not put himself in a position where his personal interest conflicts with his duties and responsibilities. The loyalty of members of the 8th senate to the embattled Saraki is for their personal/political interests, it has nothing to do with the interests of their constituents that they were supposed to represent. The excuse of the Senate that the postponement was to ENABLE Saraki to 'complete' the ministerial screening that he 'started', and their subsequent marching to the Code of Conduct Tribunal to show "moral" support to Saraki is a testament that they uphold the interest of Saraki over the interest of the masses that voted them into office. Their personal interests as loyalists of Saraki also conflicted with their duties as Senators and subdued it, which is a breach of their code of conduct. It is more embarrassing to the fact that the Senate chose to defer the ministerial screening that serves public interest at this point of our national life in the name of loyalty to Saraki that is facing criminal trial. The Senators would rather converge at the Code of Conduct Tribunal instead of their red chamber. Is this not an embarrassment to the Senate as an institution? We all know that Saraki is on trial for alleged criminal offences before the Code of Conduct Tribunal, but is the Senate also on trial? May God Bless Us All and Bless Nigeria |

The Nigerian Senate is on trial .. Saraki, Akpabio ..to mention a few .. ..and the Constitution did not forbid them from backing their colleague and leader .. ..For me, the Senate should just suspend plenary and other activities till Nov.,7 .. ..All for One! |

I wonder oo! But whatever impunity and corruption that is on display now, was established by the PDP led govt. Impunity was their way of governing. Now it is very difficult to eradicate it. They were the first people to follow Saraki to court. Olisa Metuh immediately started castigating APC as if Saraki is a PDP member. Their love for corruption and impunity is so deep that it is difficult for the Senate to see it as an offence to leave their duty post and rally round an accused. I have said it times without numbers that OUR SENATORS are THIEVES that only cares about themselves. The earlier we begin to ask them questions, the better for Nigerians and not Parties(APC PDP PDM KOWA, I don't care). Pls dont quote me if ur a wailer with the exception of the OP. |

Akpabio, Saraki etal are 'Senators' and not the Senate. They are not the first Senators to be quizzed and tried in Nigeria. The constitution allows for at least 1/3 members of Senators to be present to form a qorum. The Senate as an institution is not the personal property of ANY senator. It belongs to Nigerians, hence, their ongoing investigation/trial must not affect the activities of the Senate. In fact, this is one of the reasons some of us called for resignation of Saraki. Saying that planery be suspended is unfortunate. The Senators are the ones putting the Senate on trial and it shall be resisted dunkem21: |

Dannyset:As institutions, political parties are meant to strenghten democracy and not frustrate it. The action of party chieftains on this Saraki issue irrespective of their position should not conflict with Nigeria insterest. Where it does, Nigeria interest must take pre-eminence. I recognise the right of everyone to support/oppose a particular interest, but when such interest is against public interests, one have to speak out against it. |

I remember Tambuwal shut the house of reps for over 5 months for a mere defection .. ..The senators have a right and choice to be where they want to be at any point in time .. ..It would have been a different case if the Senate is open for activities and the honourables went to CCB .. I am with the senators on this ..they should all be present when the final decision is taken by the CCB .. All for one! |

When two elephants fight, the grass would suffer. Nigerians would be the ones to bear the loss of this act, and not Saraki or APC. For this regime, most of the players in the games of former opposition party has achieved their aims (Amaechi still pending). Once a senate president is always a senate president even if its for 3mths, Its in Nigerians interest for all to be at peace. (A speedy trial and quick acceptance of Ekweremadu's would made a leap towards that). |

The Senate is on trial because PDP owns the senate and it is in their character to romance corruption at all times, until the APC takes full control of the house by unseating saraki, then our senate will become more responsible and what happened yesterday will not happen again. But for now PDP is the majority since there are senators who are PDP in soul but APC in paper. I hope with these few points of mine, I have been able to convince and not confuse the OP why the senate is o trial ![]() |

Sorry sir, the Senate is NOT a body that is made up of 109 members, it is an institution that provides for 109 representatives of the population who are to act on BEHALF of their respective constituents. Membership of the senate is determined by the masses and it is not permanent. It only last 4 years. The senate is not a social club or some voluntary organisations. It is guided by laws that are backed by relevant constitutional laws. It doesn't belong to 109 senators but the entire Nigeria people. Same way no organisation belongs to the employees but to the employer them bring in employees to perform specific task on his behalf. dunkem21: |
