This judgment is monumental fraud. I am a card carry member of APC but I do not take this. PDP has right to nominate there candidate even in headquarters or any where. Did a PDP. Card carry member go to court. It Is only in court that a card carry member of PDP can challenge to that. There consensus in parties. He is card carry member of PDP. Like I said in 2011 that APC will win in 2015 but will last in power only 4 years, that is going to happen because all that were reveal to me is what is happening now.

listen.primary election is intra party which only an aspirant therein can question, not the opposing party nor its candidate. So as long as there is no challenge coming from Pdp on that issue, it is given.
If a rerun is called and Pdp presents it's former candidate, it is still a Pdp aspirant that can still challenge it then.
If you think Pdp ought to be excluded in a rerun, is APC the only party left in the ballot paper?

PDP shot itself in the foot here. It's no one else's fault.
How about conducting a fresh election following due process and let's see who will win instead of heating up Taaraba state. Darius has the people's mandate + dat state is too volatile for the basis Upon which this judgement was made. There is all sorts of division and crisis in the state... Religious, ethnic, political, fulani vs farmers etc

I understand your concerns and sentiments, but the law doesn't recognise those concerns and sentiments. According to the judgement, Darius Ishiaku and PDP went against the electoral laws on two grounds. One, they held primaries outside the state capital. Two, they didn't even hold the primaries within the stipulated time prescribed by the electoral laws.

Now, what this means is, Ishiaku Darius and PDP weren't eligible for the election. Therefore, they were never part of the election, to begin with. So, given all of the above, the only eligible candidate with the highest number of votes in the election was Aisha Alhassan.
It's that plain and that simple.

The Governorship Election Petition Tribunal for Taraba on Saturday nullified the election of Taraba Governor, Darius Ishaku, of the Peoples Democratic Party.
The Tribunal, sitting in Abuja, declared the candidate of the All Progressives Congress and a Minister designate, Aisha Alhassan, as the winner of the April 11 governorship election in the state.

The three-member tribunal held that Mr. Ishaku was not validly nominated as candidate of the PDP and therefore did not qualify, from start, to contest the governorship election.

Specifically, the tribunal held that the governorship primaries purportedly conducted by the PDP in the state was done in violation of section 78 (b) (1)(2) of the Electoral Act which guides parties nomination to the position of governorship candidate.

It held that contrary to the provision of the section, PDP conducted the purported primaries at its national secretariat, Wadata Plaza, in Abuja with no clear delegation from the local government areas in the state.

The tribunal sustained the testimonies of the head of election monitoring of Independent National Electoral Commission that the commission was not aware of any primaries conducted by the party in line with the provision of the electoral act which produced Ishaku as the party’s flagbearer.

Section 78 (b) (1)(2) of the Electoral Act states: In the case of nomination to the position of Governorship candidate, a political party shall where they intend to sponsor candidates:

(i) hold special congress in each of the Local Government Areas of the States with delegates voting for each of the aspirants at the congress to be held in designated centres on specified dates.

(ii) the aspirant with the highest number of vote at the end of the voting shall be declared the winner of the primaries of the party and aspirant’s name shall be forwarded to the commission as the candidate of the party, for the particular state.

The tribunal said the defence by the PDP that the primaries were shifted to Abuja because of security challenges in the state was rejected by the tribunal.

It sustained the evidence of the INEC official that there was no primaries election in the state and the emergence of Mr. Ishaku through the purported election in Abuja was after the statutory stipulated time for party primaries had elapsed.

It held that since Mr. Ishaku was not duly sponsored by the PDP, the party had no candidate in the governorship election in the eyes of the law.

The tribunal therefore voided the votes of the PDP and Mr. Ishaku in the election saying “it is a waste’’ and declared the APC and its candidate, who came second, as the valid winner of the April 11 election.

Reacting to the judgment, counsel to APC, Abiodun Owonikoko, a Senior Advocate of Nigeria, said the judgment was a landmark being the first time the election of a governor would be nullified on the doctrine of wasted votes. He said with the judgment, the era of impunity in party primaries was gone and it would be a lesson not only for PDP but all political parties.

On whether Mr. Ishaku will vacate the seat immediately, Mr. Owonikoko said the judgment “is not the end of the road, there is opportunity for all the parties to explore whatever the grievance they have’’.

Mr. Owonikoko added that if the governor or the party did not appeal within 21 days, Ms. Alhassan will be sworn-in as governor.

The counsel to the PDP was not available to comment on the verdict of the Tribunal as they all rushed out of the venue after the judgment.

With this judgement, Nigeria produces the first female elected governor and froma a predominantly muslim and sharia compliant region, Northern Nigeria. My wish for her is to outperform the male governors in all states. Victory for the women folk.

There is nothing the appellate court or supreme court can do about this. PDP has lost out, plain and simple.
This is the smartest and fastest way to be a governor. I will turn this to prayer point. ''Father let my enemy present an illegal candidate, so that when the illegal candidate is removed, I can take my rightful place''. The case looks similar to that of Ameachi and Omehia.

The person you quoted is right. Virgy Etiaba was ordered to vacate the office after 2 months because the court held that Peter Obi was not properly impeached.
Therefore, in the eyes of the law, Etiaba was never a governor. Ditto for Ngige.

You COULD be very correct HOWEVER the crux of the matter is that, PDP did not go to the Tribunal to challenge HOW Okorocha became a governorship candidate rather they were challenging the fact that he won!

APC lawyers were smart in this case as the issue is not whether PDP won or not but that PDP had no candidate. Tell Ikedioha to get Madam Taraba's quality lawyers next time. The courts can't grant or decide on what you didn't bring up for adjucation.
The Muhamadu Buhari's tribunals are setting Nigeria dangerously backward. APC has no prima facie to tell the PDP or even disagree on how the PDP conducts it primaries or challenge PDP's manifestos. The challenge of PDP primary conducts should come from a disgruntle PDP candidate or INEC but not APC or its candidate. It is unheard of that another political party takes another party to court because the opposing party did not like how it conducts its internal affaires or deposits it money in the bank. What is wrong with Nigeria?

APC has no locus standi to challenge the PDP primary since APC is neither a member of the PDP or one of the PDP candidates in the primary. The evidence of INEC in this matter is a waste of time because primaries are the responsibilities of the political parties. However if there is a disgruntled candidate in the primaries, he/she could petition INEC or court of appeals.

APC can use whatever is in the Law against PDP. The guidelines for primaries are in the electoral act not party manifesto. It is an established law.

You actually write from a position of ignorance. The Supreme Court has already ruled that the "qualification of a candidate from the primaries" is an election matter. So from the position of the law, how PDP selects its candidate is not only for PDP members/candidates but also for all parties involved in the elections.

It is simple, even in your Final year at the university, if it was discovered that you forged your school certificate, it won't make a difference that you are now bright or even if you are the brightest in the school, you will be sent away.
