My take on this matter is simple,I believe INEC erred in saying the election in Kogi was inconclusive and here are my reasons. 1) APC was leading the race with 41,000 votes according to INEC 2) The total number of voters out of the 49,000 voters in the INEC voters register that collected and have PVC's is 25,000 voters. 3) The number of accredited voters in the 91 polling booths were election were cancelled was less than 15,000 voters,that is all the voters that turned up to vote in those areas that INEC cancelled the results. So as far as I am concerned the election was conclusive because the 'eligible voters' in the 91 polling booths are less than the number of APC's lead. A voter who has his name on the INEC voter's list and who fails to collect his/her PVC is not a voter in the real sense of the word,without a PVC you can't vote. What is the way foreward? The way forward for me is for APC and their Deputy Governorship Candidate,James Faleke to go to court and force INEC to declare the election of last Saturday conclusive and announce APC as the winner based on available facts on ground. If APC is trying to play politics and deny Faleke as we seem to be seeing then let Faleke on his own go to court and force INEC to do the right thing. I am strongly of the believe that the decision of INEC to do a supplementary election and allowing APC to replace the late Abubakar Audu with another person will be nullified by the courts as [b]I see no logic how anybody can inherit the votes of Audu to contest in the supplementary election,the votes of a candidate in an election can never be transferred to another candidate to use and complete an election process,not possible.[\b] Let APC go to court and get their mandate and let Faleke become Governor.
Exactly, late audu is the candidate with d highest number of votes and d replacement cant have more than 49000 votes.. Definetely we'll have two winners... D one declared by inec and late audu who has d highest number of votes.

Faleke will win this very easily in court. This guy cannot come from the clouds to claim votes he never campaigned for. Faleke was on a joint ticket with Audu. So he has more rights to the votes. Faleke should go to court and get an injunction to put the election on hold until the matter is resolved. No time. Such an issue should not be left open to interpretation and abuse. Buhari, tread wisely. We are watching.
aside what apc has done what exactly do u expect apc to have done? u saw them quoting the electoral act o...faleke none mohammed audu will last as gov if pdp challenge their mandate cos as according to the electoral act they are not qualify so for me apc has done well for bringing yahama since he came out 2nd in the party primaries.....

As an Igala I can say confidently that fielding Audu's son would have been a mistake initself since that cannot stand the legal fireworks. Also that guy has alot to learn in politics. When his dad was alive, he always shun youths who brought great ideas to him to pass to his dad. His favourite saying then was - "I am not a politician but a businessman; leave me out of this". All of a sudden some people who think he will be controlled by them started throwing his candidature up. That said, who knows if he would have been excellent Gov just like the once unknown Fashola.

On the second note, Yahaya Bello called Fairplus massively funded the Buhari Osinbajo campaign in Kogi donating many buses. Audu supported and rallied Pl delegates for his friend Kwankwaso against PMB. Fairplus ran the most organized campaign when he vied for Governorship. However he disappointed his fans when he refused to support Audu rather he decamped to SDP first and later ran back when he saw that he had a case against Audu's emergence at the APC Hqtrs. When his petition was thrown out, he funded Wada.

Now food is ready and Audu has won the election and he has come to reap the labours.

As for Faleke, he also has a good case. But the case of Fairplus is stronger and can stand the test of time.
I advise both of them to work together to do the kind of developments that Kogi has never seen in all the years ruled by Igalas Govs. That is the only way they can win the hearts of the normal igala populace. Hunger and poverty do not differentiate between tribes and religion. At the market, they don't ask you for your tribe before they sell to you.

i really appreciate your comments. I dont know that people that are really literate and understand politics as well as legal implication of whatever decision make by APC are here. For APC to do another primary would have put in a more risk of loosing the whole battle to PDP @ law court exept a new election is to be condycted but going by this choice; pdpd had been legally knocked down already.

If they choose faleke pdp would win in court the way mama taraba won since he didn't paticipate in primary. He was only chosen by party and Audu.

Old man, this has nothing to do with Tinubu or getting pained. It's all about justice and doing the right thing. Any which way this case is decided, the court will still have the final say. Wada is already in court so, Faleke should go and join him there.

They felt it is better for him to learn the ropes in the state before becoming a governor.

As for Igalas, i think is time to give the Ebiras chance to rule, cos kogi has never seen any meaningful development under the igalas apart from probably Audu's govt.

The best choice made by APC. PDP will be licking its wounds now. Now the progressives will be coasting home to victory.
Meanwhile, Alhaji Yahaya Bello a.k.a Fairplus, I learnt you have enough money to throw around, please don't be the Almakura of kogi state. Your state needs more than the incumbent and his predecessors have given to the state. The onus lies on you to prove your worth.

This is one of the few reasonable and literate comments posted here. No body supporting Faleke has been able to back up his or her claims citing the provision of either the electoral act or the constitution.

They should know that Section 181(1) of the
Constitution of the Federal Republic of Nigeria would
have been invoked. It says ‘if a person duly elected as
Governor dies before taking and subscribing the Oath
of Allegiance and oath of office, or is unable for any
reason whatsoever to be sworn in, the person elected
with him as Deputy governor shall be sworn in as
Governor and he shall nominate a new Deputy-
Governor who shall be appointed by the Governor with the approval of a simple majority of the House of
Assembly of the State’.
“But the scenario in Kogi is different. Nobody has been declared the winner yet so why should faleke be declared the APC gubernatorial candidate?

However, Section 33 of the Electoral Act is wide enough to accommodate this scenario in Kogi State, where a candidate dies where the election is declared
inconclusive. This is because Section 33 of the
Electoral Act is not limited to pre-election substitution
of a candidate. Pre-election substitution of a candidate is specifically provided for in Section 36(1) of the Electoral Act Section 36(1).
However, if the candidate dies where the election is
declared inconclusive as in Kogi, the party will be
allowed to substitute the death candidate for the re-run election in the affected areas. This is the intention of Section 33 of the Electoral Act. Limiting Section 33 of the Electoral Act will be restricting its intention and deviating from the purposive rule of interpretation.

Having said this, the action of APC is not only Democratic, but it also falls withing the provision of the electoral act.

Constitution allowed for substitution of candidate in case of death except before the commencement of an election. The same constitution asked the deputy to step in after the election has been validly won and something happens to the boss.

Audu died during not before the commencement of an election.

Election has not been validly won according to INEC rule and electoral guideline.

APC has won this election already. The only battle ground is the Supreme Court. That is where it would be sorted out whether the new substitute or Audu deputy is the right figure to head the government.

PDP has no case here, going to court would amount to wasting of money though that may see to development of our body of law and constitutional provisions.

There was never any constitutional crisis.Since the constitution is silent on the current scenario,whatever INEC does provided it cannot be proven to be against the constitution or electoral act,will be upheld by the supreme court.Remember,the consitution empowers INEC to conduct and give guidelines and directive to the electoral process,provided such guidelines/directives cannot be proven to be against the constitution.

So INEC gave APC the directive to replace the late Audu,they have done so .Can any one prove that the directive has breach any provision of the electoral act or constitution?

Here is the ice-breaker,section 33 of the electoral act:

It is not a risk, and nothing will happen if he plays his cards right and chooses the right deputy. All these prophets of doom are saying so for their own pockets. That Governorship is Faleke's. Who cares about going against party? Did the senate president not do the same? Yet the ones that supported the senate president in what he did are trying to stop Faleke from legitimately claiming his candidacy. Rubbish.

Your basis is Tinubu. Without Tinubu will APC be at the center? What are you saying? That alone destroys all your points. And even if he is a Tinubu boy so damn what? Does that take away from the fact that it is his mandate? Let us wait for the court decision. Stop making obviously ignorant statements because of the gain you have.

Whatever you call it, reaping fruits without planting seeds... Ebira and Late Adamu Atta has already planted the seed long ago when they call on Igala to come and join kogi state from Benue and decide to grant them seat of governorship in the state agreed to be rotating it... this fight is of God. Adamu Atta called on Prince Audu and power was giving to him without any struggle so if same is repeated is God that is fighting the battle.
