Will You Call This Rape? by PMIcon(op):
A girl was taken to a hospital in Ogun State by her mother who suspected rape.

The scenario was unusual or maybe I should say funny. The girl was sent on errand and did not come back home that day, only to be found later in the house of one man who- it was suspected had carnal knowledge of the girl.

On examination, the doctors confirmed the presence of ejaculate in her and no sign of force being used on her.

The girl later confirmed she went to meet the man herself and that that was about the third time they had such an affair.

Was this a rape? Remember, a minor was involved but she is only that by age.

The Child Rights Legislation stipulates that having carnal knowledge of a person below the age of 18 is a crime in about 24 states of this country of which Ogun state is a signatory to that act. But there is a clause and that is where a marriage (traditional or religious) has taken place, no crime is deemed to have been committed.

This incident happened in Ogun state, she is below 18 and not married. This follows that under the law, she lacks the authority to provide consent to the act especially when the partner is an adult.

Thus, this is a rape. We need to see rape beyond forceful sexual intercourse to include wilful sexual intercourse with a person who lacks the authority to grant consent e.g child, drunk, person with mental disability etc.
