On Tuesday, the Federal High Court in Lagos barred MTN Nigeria Communications Limited from moving any funds abroad it may have in Nigerian banks until the hearing of its suit challenging the N1.4 trillion fine imposed on it by the Nigerian Communications Commission (NCC). The Federal Government brought a motion to restrain the 21 commercial banks, in which MTN has funds, from releasing money to the telecommunications giant. “The FG seeks an order of Mareva injunction [a court order which requests assets be frozen] restraining the aforementioned banks from releasing, making a sale, transferring, or paying any of the monies maintained by the plaintiff MTN,” the motion read in part. In October, the telecommunications giant was originally hit with a massive $5.2 billion fine by the NCC for failing to disconnect unregistered subscribers. This failure was in direct violation of regulations put in place by the NCC in order to combat the uptick in kidnappings and the Boko Haram insurgency, both of which often involve the usage of cell phones. The fine was eventually reduced to $3.9 billion in December. However, MTN is suing the NCC and the Attorney General of Nigeria, Abubakar Malami, contending that as a regulatory body the NCC does not have the right to assume all the functions of the state. http://saharareporters.com/2016/01/12/mtn-barred-accessing-funds-nigerian-banks |

These corporations do not understand that the era of - Chop and Clean mouth has been suspended in Nigeria This is not a Jonthanian, corruption led and ogogoro fueled administration, companies can no longer act with impunity and hope to clear their mess by feeding Jonathan's lifelong ambition of uncontrolled Ogogoro consumption. There is a new Sheriff in town. A man of process and principles! How MTN thinks that they can circumvent the decision of this government is laughable. Nigeria is their biggest market in the World. They make over 25% of their global profits in this country. As a business, they have to adhere to the rules of their host economy. Nigeria is the biggest market for Telecoms and IT in Africa. MTN are replaceable and they know this. They cannot try half of these stunts in Uganda or SA. Nigeria is under new Management! The sooner MTN realises and accepts this FACT, the better for them. |

Lalasticlala This deserves FP. @ Topic I feel both sides should sheath their swords, have a sit down and seek ways to achieve a common ground. When two elephants are fighting, it is the grass that suffers. Having said that, MTN has to really work on its public policy department. They have not handled this issue professionally. |

That's better Allowing MTN access to funds is like leaving a loaded gun with a toddler And the Fine was even legal , why is MTN refusing to pay after all the fraudulent deductions from user's accounts I did not subscribe to anything but they kept charging me twice a week for caller tunes throughout december and data ? One movie and 4 gig turns to 800 MB MTN should pay up afterall the fine's been reduced |
