Chief Mike Ozekhome (SAN), a renowned constitutional lawyer has expressed displeasure over President Muhammadu Buhari’s continued disrespect for the rule of law.


He said those advising the president to put Nigerians on the stakes and shoot them to death, without even trying them in the fight against corruption were his worst enemies, Vanguard reports.
Speaking with newsmen on Wednesday, January 13, the outspoken lawyer said Buhari will know those deceiving him when the chips are down.

“Those who may be telling the President that oh! You are fighting corruption, put Nigerians on the stakes and shoot them to death, don’t even try them! They are deceiving Mr. President. When the chips are down, Mr. President would see that those were his greatest enemies,” he said.

Ozekhome, who was apparently not happy over the federal government’s refusal to respect court orders that granted some accused persons facing corruption trial bail said, the rule of law has so far been put into perpetual retreat and Nigeria has never had so bad.

According to him, once the court has decided a matter, neither the president, Senate president, nor the speaker of the House of Representatives has the power to tell a court of law that the bail you have granted we are not obeying it because of that hallowed doctrine of the separation of powers.

He said: “Under the Yar’Adua /Jonathan period, you could abuse president Jonathan. People described him as clueless; some politicians even described him as the drunken Ijaw boy. They ridiculed and caricatured Patience Jonathan with her mode and manner of speaking but never for one day did we hear a writer or journalist being picked up for that.

“Even if Nigerians were hungry, Nigerians enjoyed one thing in the last administration which was respect for fundamental human rights. I am afraid that under the present government of President Buhari, the rule of law is being observed more in breach than in compliance.”

He explained that after a court of law has delivered a judgment and set free an accused person on bail, the accused person must go on bail and it is not for the president to say such person will would not be released on bail because they would jump bail.

The lawyer said by doing so, the president was “making himself a superintendent and overseer and an appellate court over decisions of a court of competent jurisdiction which under a constitutional democracy like ours and under the rule of law can never be possible.”

According to him, the only thing the government can do is to appeal against that judgment or apply to set it aside.

Ozekhome advised Buhari to obey the rule of law and ensure that various security agencies respect the fundamental rights and liberties of Nigerians.

He noted that even prisoners of war are entitled to fundamental human rights, so in the fight against insurgency and corruption, the rights of the Nigerian citizens are still to be respected.

“So Mr. President must be told in very clear words that there is no option to respecting the civil liberties and fundamental human rights of Nigerians,” he added.


Four days back, Human rights lawyer, Femi Falana (SAN) had cautioned President Buhari to ensure the rule of law was respected. He said Nigerians were fully behind the Buhari administration in the patriotic move to recover the nation’s looted wealth, but the federal government should follow the tenets of the rule of law.

According to him, the re-arrest of the immediate past National Security Adviser, Col. Sambo Dasuki, and the leader of the Indigenous People of Biafra, Nnamdi Kanu, after they were granted bails by different courts amounts to impunity.

Ozekhome is getting emotional by bringing in Jonathan and the issue of his wife's grammatical blunders, who is deceiving who? is it because PMB has not allowed himself to be deceived like they [including Ozekhome] deceived Jonathan?

FG has inaugurated the Presidential Advisory Committee against Corruption and appointed Professor Itse Sagay (SAN), a prominent professor of law and civil rights activist, as its head.

THISDAY yesterday exclusively reported the constitution of the committee and its membership.

A statement by the president’s media aide, Mr Femi Adesina, said the committee’s brief was to advise the present administration on the prosecution of the war against corruption and the implementation of required reforms in Nigeria’s criminal justice system.

The committee is also expected to develop comprehensive interventions for achieving recommended reforms.

The statement said in support of the federal government’s efforts, an Anti-Corruption and Criminal Justice Reform Fund has been established by three international development partners, namely, the Ford Foundation, MacArthur Foundation and Open Society Foundation.

“The $5 million fund is to assist implementation of key components of the action plan and the work of the Presidential Advisory Committee.

“The fund will be managed by Trust Africa, an international development civil society organisation with programme presence in more than 25 African countries,” the statement said.

Other members of the committee are: Prof. Femi Odekunle, a professor of Criminology of Ahmadu Bello University; Dr. Benedicta Daudu, an associate professor of International Law, University of Jos; Prof. E. Alemika, professor of Sociology, University of Jos; Professor Sadiq Radda, professor of Criminology, Bayero University, Kano; Hadiza Bala Usman, civil society activist; and Professor Bolaji Owasanoye of the Nigerian Institute of Advanced Legal Studies who will serve as the executive secretary of the committee.

What Rotimi Amaechi suffered under Jonathan no man can ever experience such let alone a sitting governor. Amaechi's jet was grounded, his car was stopped, his security detail was withdrawn, the stadium was shut, 7 honourables in the house impeached 22 to unseat him, he was publicly insulted by the wife of the President, etc Where were you then sir?

When the car carrying Alhaji Lai Muhammed, Rotimi Amaechi ,etc to Ekiti was stopped and PDP members cars that met them on the road were allowed to enter Ekiti where were you?

When the current governor of Kaduna was locked in the hotel and was given house arrest in Anambra where were you? When Ali Mohammed and others were arrested by DSS under Marilyn Ogar for wandering in the eve to Osun State last election where were you?

When the Office of APC in Lagos (Ikeja) was burgled and all their data systems were carted away by DSS with no reason where were you? Till today nothing was brought out of the case.

When the then Speaker of the House of Reps now Sokoto State Gov was stopped and asked to trek to his meeting place last year with all his security men being incapacitated by the 'Power that be' where were you?

When Ribadu was sent away and El-Rufai was forced to run abroad under Yar adua, where were you? Whereas people like Ibori were having the fun of their lives.

Please stop being partisan as a lawyer. Both Mike Ozokheme and Barrister Onangoruwa are PDP members parading as neutral individuals.

The judiciary is the stumbling block to fighting corruption in Nigeria. The lawyers and judges are very corrupt.

don't mind them jare, the rule of law went to sleep during all those times but its wide awake now because of PMB. The pdp are the greatest violators of the rule of law that ever liveth
