– Peter Odili’s case began in January 2007 when
the EFCC issued a report of its investigation into
the finances of the Rivers state government


– The case has been stalled since Justice Ibrahim
Buba granted a perpetual injunction restraining
the EFCC from probing Odili


Magu says there is a perpetual injunction
restraining EFCC from probing Odili.
The chairman of Economic and Financial Crimes
Commission (EFCC), Ibrahim Magu, has said the
commission cannot prosecute former Rivers state
governor, Peter Odili, because of a perpetual
injunction granted by a court which stopped the
anti-graft agency from probing the former
governor.


Magu who disclosed this yesterday, February 29,
in Abuja told the Leadership that the efforts of
the EFCC to appeal against the court order
restraining it from investigating Odili has been
frustrated by the Court of Appeal which has
declined to list its appeal against the injunction
since 2008.


Likewise, an EFCC prosecutor Johnson Ojogbene,
complained that the issue of court injunctions
have hindered the commission from carrying out
its duties because there is nothing anyone can do
about a court judgement except to obey it.
Peter Odili’s case began in January 2007 when
the EFCC issued a report of its investigation into
the finances of the Rivers state government under
Odili.


The report alleged that over N100 billion of Rivers
state’s funds have been diverted by Odili among
other serious allegations of fraud, conspiracy and
conversion of public funds.


Following the indicting report, on February 22,
2007, the then attorney general and commissioner
for justice for Rivers state filed a suit challenging
the powers of the EFCC to probe the affairs of
the state and claiming that the activities of the
EFCC were prejudicial to the smooth running of
the government of Rivers State.


Subsequently, Justice Ibrahim Buba granted a
perpetual injunction restraining the EFCC from
probing graft allegations its operatives levelled
against the former governor.
The case has been stalled since then.
