I am a domainer (i buy and sell domains). I have some knowledge about trademark.


If you are wise follow this tips i will give you now.

1. Remove every of your write up that contain facebook etc.

2. Remove/ block every ad that show facebook.

3. remove every logo of facebook from ur site.

Though this is some how a serous case because you are also in the same niche which facebook. also ur domain was reg jan 2015... All this a pointing to bad faith bro.

Now this is my brotherly advice to you:

Take down your domain name reg another domain and continue with ur site but never for get advice: 1, 2 and 3 even when you have gotten another domain.



Once again take down the domain.

if your site was registered Jan 2016 and its a social network for friends and family with the name facekobo.com
then certainly, your domain name drew inspiration from Facebook.com domain name.
In that regard, they have a strong case against you.

If I'm sure about anything, it is the fact that the OP will not be getting a dime from Facebook. Thanks to internet caching, all references to Facebook and the abuse of the Facebook trademark which he might have hurriedly edited are still saved-up in the cached versions of his website which he can't edit. Siddon there make dem dey job u. Go and ask if recently anyone has made any money from Pepsi or Coca-Cola for finding particles in their drinks (since that is where you are drawing your inspiration from). You are just an opportunistic indolent twerp looking to reap where you didn't sow. Banza!

Aside from the fact that the Nigerian owner of faceKOBO.com allegedly made the mistake of stating that his site is an alternative to Facebook, it's unfair to attack him for choosing the domain name faceKOBO.com

Why?

1) Face KOBO could mean many things especially "focus on the kobo" (i.e. focus on spending little). In fact, I wish the owner of the site can forget about making faceKOBO a social networking site and instead make it a site about financial advice from a Nigerian perspective. That way, Facebook will have absolutely no case against him as it'll be two different genres.

2) Our KOBO has been existing long before Mark Zuckerberg ever thought of Facebook.

Meet or look for a lawyer in the US to take the case to court and ask for $300Million for the domain transfer to them for life,even if they agree to pay 10% and you settle all legal fees,I see no way you would not get $2Million.
Its either they agree to buy the domain name at a price you want or stop all these e-harassment. cry

I don't know much about IP.

Nigeria is a large market for Facebook and they will consider any threat to it as serious.

Domain names are labels and identities for web services therefore can be registered as a trademark. Trademark registration is territorially enforceable. A trademark registered in the US covers only US territory. And the IP owner has to register his trademark in every country he wants it enforced. However there are treaties which make a single registration valid for over 100 countries.

Nigeria could be one of them. And if Nigeria is, they have a good ground to drag you to a Nigerian court and nail you, and you would pay a lot in damages.

I can only give an opinion whether you infringed on Facebook's trademark. The pertinent questions are, whether Facekobo can easily be mistaken for Facebook? Both have same letters, supposedly delivering the same services. And Facebook is an international brand forged in the consciousness of millions of people worldwide. And there is an element of bad faith in trying to take advantage of Facebook's goodwill.

The best step is to consult IP lawyers. Not Festus Keyamo.

Facebook actually made attempts to shut down Facekobo.com last year through a request to my host, but they got a shocker their lobbyist law that allows a big company to swallow new startups does not apply to my host country. If I had bought my domain in USA or was hosting in USA, I would have been taken out without notice.
