I think the ambiguity is stemming from any commercial usages of memes.

If it involves any commercial value accruing or non accruing to a user or usee, then it brings legal questions.


Since celebrities are public figures who make money from their photo ops, the issue of memes is increasingly becoming one which they feel should be straightened out if a cash value can be derived from them.

Possibly, a way out might be having regular people as meme foci.
