On June 14 some officials of the EFCC numbering about 20 stormed the home of Former Minister of State for Defence, Musiliu Obanikoro situated at 10 Mojisola Onikoyi Street, by Banana Island, Ikoyi, Lagos and took away several items, some of the items seized by the Commission include: building plans, cheque leaflets, company documents, car keys, phones, two company seals and six company stamp. They proceeded to also search the personal house of the former Minister at 4 Layi Ajayi-Bembe road, Parkview, Ikoyi, Lagos Before the invasion of the premises there was no prior notice by way of letter or invitation and there was also no order of court mandating them to carry out the action. The EFCC claimed they carried out the raid on an ongoing investigation involving Mr. Musiliu Obanikoro. The issue before us is not wether Mr. Musiliu Obanikoro is guilty or not guilty of the crime leveled against him as it is only a Court of law that can pass the judgment but the manner at which the EFCC are going about it's duties is quite worrisome. -Does the EFCC have the right to carry out a raid on the property of a citizen without a warrant or a mandate from a court of law? -Is there a constitutional backing on their action? -Are they given the power to seize items in the house without a court injunction? -Is the EFCC now the investigator, prosecutor and judge? -What exactly is the difference between their action in a democratic system and that of a Military Regime? Yes, we want to win the war against corruption but the manner at which the EFCC are going about the battle may end up sending us back to the military era where human rights will be a privilege and not a right. Na like this e dey take start.

OP your post in full of lies and half-truths First of all, efcc invited obanikoro severally, for which he gave many excuses i.e he's writing exams, attending school, fasting etc. And even recently he came out bluntly to say he is not going to honor the invitation Secondly the raid was done lawfully with warrant. Efcc dont just buggle people's houses. When investigating they are well armed legally to execute searches and arrests If obanikoro is as innocent as u claim, shldnt he have gone to clear his name since? An innocent person shld have been eager to clear any misinformation rather than flee to US with the pretext of going to school Finally, OP u aint fooling anybody but urself. We were all in nigeria during ekitigate and we all know what happened. Your attempt to rubbish the efforts of security agencies is very shameful! |

blackpanda:You don't seem to get the point here, I am not in support of Obanikoro's actions or inactions, my point is "the manner at which the EFCC carried out the raid". Even if there was a warrant for his arrest which is still in doubt, did the warrant include "collecting items in his house"? who is going to be responsible for any missing item since it's like you go in and pick what you like? Secondly, you made mention of ekitigate of how "you were all aware of what happened" you see, that exactly is the problem with people that believe everything they read and listen to. you are quick to judge people even before a sentence from the Court of law. Nigeria has now become a place were the media decides who stole and who must go to jail, little wonder crooked politicians are investing heavily into media power to fool the majority of Nigerians. smh. |

KingOfAmebo:My dear since u are not quite learned let me educate u a little on nigerian law. The police has the power to search and confiscate any item found in the course of the search. Police does not even need warrant all the time, it can apprehend and confiscate on "reasonable suspicion". In this case, the suspicion is more than reasonable As a nigerian, one would think u would be more on the side of apprehending thieves and recovering the loot, especially in this our poor economy. But its unfortunate, that those that hate this administration (for no reason) seem to think anything anti-buhari is the way to go, regardless of the disastrous effect to the nation. Both legally and morally, u have no point. |

In other words the police has the right to burst into your house without a warrant because one of your jealous neighbors reported lies against you? How is that moral or legal? blackpanda:You are totally wrong...your assumption is based on hearsay and because you are programmed to believe what the media want you to believe. You seem to be shifting the argument from the EFCC to the Police and mind you there is no were in the Police Act that says you can burst into somebody's home and "steal items in disguise of carrying out your duty" if such Act exists then you and I won't be safe with the underpaid officers. Warrant or no warrant, there was no Court injunction asking them to remove items from Mr. Obanikoro's home. Period. |
