Sissie: Answers and scores 1. Iddah is the waiting period a woman must observe after the death of her husband or a divorce B. Different types of Iddah: If she is pregnant, her iddah ends after she gives birth this is for both a divorced woman and a widow For a divorced woman who has passed menopause her iddah is 3 months For women who still have periods and got divorced their iddah is 3 monthly menstrual circle If the woman is divorced before intercourse or intimacy with her, then she does not have to observe any ‘iddah at all The ‘iddah of a woman whose husband has died is four months and ten days 2. Procedures for a woman to seek divorce: This procedure is known as Khula Khula’ means the separation of the wife in return for a payment; the husband takes the payment and lets his wife go, whether this payment is the mahr which he gave to her, or more or less than that. The basic principle concerning this is the verse in which Allaah says (interpretation of the meaning): “And it is not lawful for you (men) to take back (from your wives) any of your Mahr (bridal-money given by the husband to his wife at the time of marriage) which you have given them, except when both parties fear that they would be unable to keep the limits ordained by Allaah (e.g. to deal with each other on a fair basis). Then if you fear that they would not be able to keep the limits ordained by Allaah, then there is no sin on either of them if she gives back (the Mahr or a part of it) for her Al-Khul‘ (divorce)” Q2:229 The evidence for that from the Sunnah is that the wife of Thaabit ibn Qays ibn Shammaas (may Allaah be pleased with him) came to the Prophet (peace and blessings of Allaah be upon him) and said, “O Messenger of Allaah, I do not find any fault with Thaabit ibn Qays in his character or his religious commitment, but I do not want to commit any act of kufr after becoming a Muslim.” The Prophet (peace and blessings of Allaah be upon him) said to her, “Will you give back his garden?” Because he had given her a garden as her mahr. She said, “Yes.” The Prophet (peace and blessings of Allaah be upon him) said to Thaabit: “Take back your garden, and divorce her.” 1. From this case the scholars understood that if a woman cannot stay with her husband, then the judge should ask him to divorce her by khula’; indeed he should order him to do so. The wife request her husband divorces her or goes to the court With regard to the way in which it is done, the husband should take his payment or they should agree upon it, then he should say to her “faaraqtuki” (I separate from you) or “khaala’tuki (I let you go), or other such words Talaaq (i.e., divorce) is the right of the husband, and does not take place unless it is done by him, because the Prophet (peace and blessings of Allaah be upon him) said: “Talaaq is the right of the one who seizes the leg (i.e., consummates the marriage)” i.e., the husband. Sissie: Black Companions Umm Ayman raḍyAllāhu 'anha (may Allāh be pleased with her) was one of the early adherents of Islam in Mecca and was one of those who faced persecution from Quraysh. She raḍyAllāhu 'anha (may Allāh be pleased with her) was among those who migrated from Mecca to Al-Madinah. Usamah bin Zayd raḍyAllāhu 'anhu (may Allāh be pleased with him) was one of the beloved companions of the Prophet ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him). Both of Usamah's raḍyAllāhu 'anhu (may Allāh be pleased with him) parents, Zayd bin Harithah raḍyAllāhu 'anhu (may Allāh be pleased with him) who was Arab and Umm Ayman raḍyAllāhu 'anhu (may Allāh be pleased with him) who was Ethiopian, were freed from slavery by the Prophet ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him). He was born in Mecca seven years prior to hijrah and is described as having black skin. Sa'ad Al-Aswad As-Sulami (RA). Sa'ad was from the Ansari, Sa'ad was later martyred in a battle in which it is narrated that the Prophet ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him) wept over him while holding him in his lap. Julaybib: Julaybib accepted Islam in Al-Madinah, thus is described as one of the men from the Ansar. His lineage was unknown among the Arabs which made him an outcast. According to ibn Al-Jawzi in Tanwir Al-Ghabash, he was described as black (aswad). Ammar bin Yasir raḍyAllāhu 'anhu (may Allāh be pleased with him). 'Ammar is described in Al-Mustadarak 'ala As-Sahihayn by Al-Hakim and authenticated by Adh-Dhahabi as being tall in stature, black in skin color and having kinky hair. His father Yasir raḍyAllāhu 'anhu (may Allāh be pleased with him) was Arab. 'Ammar was one of the earliest Muslims to accept Islam and was regularly tortured along with his family. Abu Dharr raḍyAllāhu 'anha (may Allāh be pleased with her). Abu Dharr's full name was Jundab bin Junadah from the Tribe of Ghifar. He was described by ibn Sa'ad in At-Tabaqat Al-Kubra and others as being tall with brown (asmar) skin. Ayman bin 'Ubayd raḍyAllāhu 'anhu (may Allāh be pleased with him). Ayman's roots were Abyssinian through his mother. He was born through the union of his mother Barakah, a woman who was eventually freed from slavery by the Prophet ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him) and his father 'Ubayd bin Zayd who was from the tribe of Harith bin Khazraj; their marriage took place in Mecca in the Era of Al-Jahiliyyah. They would be allowed to carry swords in their sheaths and nothing more. 5) The treaty was for a limited period of time, ten years from the date of its ratification. The Messenger of Allah (saw) and Suhayl signed the treaty amidst agitation and anger of the Muslim army. Suhayl returned to Makkah leaving the Messenger of Allah (saw) disturbed and exasperated by the reaction of the Muslims. The Messenger of Allah (saw) felt awkward and depressed about the stand of the Muslims, their eagerness and zeal to fight, and he went to his wife Umm Salamah who was accompanying him and confessed to her his anguish. She said to him, “O Messenger of Allah, verily the Muslims will not disobey you, they only are zealous about their Deen and their Iman in Allah and your Message, shave your head and slaughter your animals and you will find that the Muslims will follow suit, then march with them back to Madinah.” The Messenger of Allah (saw) came out and shaved his head, marking the ‘Umrah after which he felt calm and satisfied. When the Muslims saw him in that state they rushed to slaughter the animals and shave their heads. Then Allah’s Messenger (saw) returned with the Muslims to Madinah. When they were half way back, Sura al-Fat’h was revealed. Allah’s Messenger (saw) recited it in its entirety and it was then that everyone realized that the treaty of Hudaybiyah was indeed a clear victory for the Muslims. As soon as the Muslims had arrived in Madinah, the Messenger of Allah (saw) began drawing up plans to deal with Khaybar and spread the Message of Islam beyond the Arabian Peninsula while strengthening Islam within it. He (saw) wanted to take advantage of his truce with the Quraysh to concentrate on abolishing a few pockets of resistance and to establish foreign ties. The treaty enabled him (saw) to achieve this. The Messenger of Allah (saw) managed to carry out the plan that he had so shrewdly pieced together under the pretext of performing the Hajj. Despite all the various difficulties and obstacles, he (saw) managed to achieve all of the political goals he had set out to achieve. Thus, without a shadow of a doubt, the treaty of Hudaybiyah was a great victory. Some of its achievements were: 1) The Messenger of Allah (saw) managed to create public opinion for the Message of Islam among the Arabs in general and among the Quraysh in particular. This enhanced the respect of the Muslims and diminished that of Quraysh. 2) The belief and trust of the Muslims in Allah’s Messenger (saw) was demonstrated. It proved that the Iman of the Muslims was unshakable, their courage and readiness to sacrifice themselves were second to none. 3) The Muslims learned that political maneuvers were an effective means to promote the Islamic Da’wah. 4) The Muslims who remained in Makkah among the disbelievers formed a pocket within the enemy’s stronghold. 5) The Hudaybiyah treaty demonstrated that the method in politics is derived from the same thought (source), truthfulness and faithfulness. However, the means must be coupled with shrewdness, and this can be achieved by concealing the means and the real aims from the enemy. tunshe: My Applaudable gratitude goes to the organizers wizeboy and Sissie, It's not just about the price or compensation but about what everybody has learnt in the course of participating in this intellectual quiz that serve as an eye opener in seeking knowledge about the deen. I must confess, I do think I have a well detailed knowledge base about Islam, but this competition made it glaring that we need to strive more and do more research. Once again thanks to the organizers and the cheerful giver who promised everybody. May Allah continue to enrich your purse all. and to my fellow participants, May Allah be pleased with everyone of us, grant our supplications and make us a better Muslim.
