Let us get one thing clear from the start. Aside from the Executives in this country and Principal Heads of the Legislature. Nobody is immune from arrest really for criminal offences by the police. Having said that, it is important for me to say boldly and categorically that I strongly believe that the men of the DSS didn't have warrants to arrest these gentlemen - no matter what Hogwash they want to sell using the Media propaganda machine of the APC. I have also taken time to read different accounts of what happened in the media as allegedly stated by the SSS and all were given by anonymous sources; not one single official P.R.O officer attached to the SSS has spoken; and it is strange that SSS hasn't deemed it fit to hold a press conference explaining in clear terms what's happening. No official statement has been given by the SSS till now. Yet everybody knows that the SSS had a search warrant and an arrest warrant when they went there, simply by virtue of anonymous sources. Instead, they are testing the waters with anonymous sources first to see if Nigerians will buy their madness; before they move further. For the record, a warrant for arrest is issued by a Judge only. DSS asking a judge for a warrant to arrest a judge over receiving cash to deliver judgement won't fly; and even if that happened in this case, such a judge will be sanctioned by the National Judicial Council why?? Ethical grounds. The Judiciary isn't just a profession or a system of professions, its an arm of government. Just like the executive and the Legislature. First of all, it is outside the brief of the DSS to investigate such cases. DSS will only move outside it brief except prompted by orders/directives from "My Oga at the Top". Its like saying, Federal government Hospitals have started administering health care services to stray dogs. It makes no sense.It would take only a directive from the very top to cause such agency to work outside it brief - most especially when you consider that such a action/operations require a budget to prosecute them. Who will authorise the release of cash for a government agency to do another agency's work?? Also the police won't be so stupid to seek a warrant for arrest for such men/issues, matters relating to disciplinary action concerning unethical behaviour of Judges in handling Court cases is the exclusive preserve of the NJC. Taking any action and saying you want to prosecute them first without going to the NJC won't stand a day in court. If you like, make your belle sweet say them arrest big men for a change in this country. All you simply did, was expose their activities but in the end, you ruined your chances of sending them to Jail through due process. What's the value of a sting operation that cannot lead to a prosecution/successful conviction?? It likes qualifying for the world cup and having ball possession of 86% but losing every match. Does it have any value, considering that whether you will or lose you are going pay the team at the end of the day. This is what DSS has done, that wailing wailers are crying about and Hailing Hailers are rejoicing over............ Do it with due process and let Nigerians reap the benefit and not APC or Buhari. It is the countries money that was used to sponsor this mess and it will lead us nowhere. DSS has no business handling corruption cases. My worry is the motive of the president on the arrest of these judges since he has a vested interest in the court cases some of them are looking into or have ruled in the past. Is he trying to intimidate them into ruling in his interest? If there are 'corrupt' judges who are favourable to his interest will they also be disgraced this way? Are we right to term anyone who is arrested automatically corrupt and guilty? |

mapet:Guy no dey form Lawyer for Nairaland here. The Judges were allegedly under investigation for allegedly taking bribes to deliver judgement in favour of the bribe givers. In fact according to the last comment allegedly made by the "Anonymous top source in the DSS"; they went to the NJC to present the case of a Judge who was bribed #200million to influence a case but the alleged judge didn't deliver on the Job. NJC is statutorily forged exclusively to appropriate disciplinary measures on Judges strictly with respect to unethical behaviour with respect to handling of Court cases/proceedings within the Judiciary as an Independent arm of Government. There is no other agency qualified by law to do so. So to even be typing all this mumbo jumbo, is proof of lack of understanding of the Basics of the Judiciary as a whole as an arm of government. The reason why everyone will and should blame Buhari for this madness, is because the DSS went out of it brief as statutorily prescribed by law - an action only the President can sanction - because it intends to play up the case as a matter of National security. You think the NJC was forged out of foolishness?? Because you think you will have more experience as a pen lawyer compared to a judge in arguing/forging/preparing a defence in court Unfortunately, after all this political sommersault, they will still have to go back to NJC as no court in the land is qualified to entertain such an ill-forged matter. The Executive has no business meddling in the affairs of the Judiciary. The Judiciary has its internal control mechanism and if that is faulty should be repaired not destroyed. The Executive should petition the NJC and back it up with evidence and let the people decide whether action is being taken through the Legislature. That is the way democracy works. Now this has happened and the authority of the Judiciary has been undermined who amongst them will be able to stand against the Executive, this government specificaly when it errs without fear of reprisals. I am beginning to have absolutely no hope in this administration. Anyone for any reason whatsoever who does not support, build and nuture institutions is setting this country back. Am just sick and tired of this one man show that is proving time and again to hurt this country's overall long term interests. No matter how loving a parent is, he cannot sit an exam for his child. He can only teach, nuture and pray for growth and knowledge. The executive is trying to do what it should not be doing. It will not allow this country to develop. Buhari cannot and will not remain there forever. If he does not allow Nigeria to grow it will be disastrous in the future. The aftermath of totalitarian regimes from Houphet Boigny, to Seseseko to Pinochet to Ghadaffi to the late Chavez is better imagined than experienced. The people always suffer tremendpusly from the 'I know it all and do it all' phenom afterwards. There is a reason for seperation of powers but what we see today is the truncating of government, first it was war against the Legislature and the capture of Saraki and Dogara by the net of graft, padding, whatever, now is the war against the Judiciary so that the Executive has a free ride without checks and balances... |
