Hello nairalanders and lawyers in the house, i have a situation that needs urgent answers. here it goes: if i boarded a taxi to somewhere and while en route my destination there was traffic jam, so I decide to come down and trek instead, i pay off the taxi guy, as i was about to open the door, the taxi man told me to wait, which i didn't hear, I opened the door and the door hits another car's head light (mind you the taxi wasn't parked properly, just in the middle of a 3 lane traffic) who is to pay for the damages? the owner of the taxi or the passenger  if the case is taken to the court, will i lose? cos i feel i shouldn't be the one to pay, he is the one to pay since he's the owner of the taxi, and he wasn't parked properly, and i didn't hear him before opening the door. |

May be you wanted to know something........ You are the one to pay, you are not suppose to open your cab door if not properly parked, Ok, what if it was trailer coming your side with high speed, and you saw that coming, and the cab driver asked you to step down, would you have done that?, Go and repair someone vehicle and stop complain 1 Like |

Firstly, if you are the front seat passenger in a car, and you are not wearing your seat belt, is it not the driver of the car that pays the fine? I think the taxi driver should be liable, infact if he has insurance (which he ought to have), the insurance company should be liable. Secondly, dont try and work the system, trust it instead. Just call the police/FRSC and let them decide. I honestly doubt they will find you at complete fault (maybe they will find you partially liable though) but at least you will be done with that problem. 1 Like |

OP, you are to fix both cars herein. Stop asking further opinion over this. You were in a hurry to come down hence the accident. Thank your God that no one died, you would have been the victim, then the driver will be charged for not parking properly. Note also that if there were other passengers in the car and they attest to the fact that the driver asked you to hold on of which you claimed you never heard, then the driver has no case to this.
